Using a Double Tax Treaty in Turkey: Residence Certificate, Withholding Relief and Tax Credit for Foreign Residents

A foreign individual or company cannot safely assume that a Turkish double-tax treaty rate will be applied automatically merely because the person lives in a treaty country. Turkish Revenue Administration practice requires the foreign resident to prove treaty residence, typically through an official residence certificate issued by the competent foreign tax authority and, where required for Turkish use, an authenticated/certified Turkish translation. If treaty residence is not properly documented at the time the Turkish payer or tax office applies the rule, domestic Turkish withholding or taxation can be imposed instead. The treaty then determines whether Türkiye may tax, at what maximum rate, and how double taxation is relieved in the residence country.

Treaty-use map

Step Legal question Evidence
1. Identify treaty Is a DTA in force between Türkiye and residence state for the relevant year? Official treaty/protocol text.
2. Prove residence Is the recipient a treaty resident, not merely a source-only taxpayer? Residence certificate from competent authority.
3. Classify income Dividend, interest, royalty, employment, business profit, property, pension or gain? Contract/payment/business facts.
4. Apply source rule Can Türkiye tax and is a rate ceiling imposed? Relevant treaty article.
5. Eliminate double tax Credit or exemption in residence state? Tax payment/withholding certificates and treaty relief article.

1. A treaty can change domestic Turkish tax, but only within its scope

Türkiye has a broad network of agreements for the avoidance of double taxation. When a treaty is in force and the taxpayer qualifies for its benefits, treaty provisions can restrict domestic source taxation, assign taxing rights or require double-tax relief.

The treaty does not create a tax where domestic law has none. Its usual role is to limit or allocate taxing power that otherwise exists under domestic law.

The exact treaty and protocol for the relevant country/year should be used rather than a generic OECD model summary.

2. Treaty benefits are generally available only to a treaty resident

Most agreements define a resident as a person liable to tax in a contracting state by reason of domicile, residence, place of management or a similar connection, not merely because the person receives income sourced there.

A limited/source-only taxpayer is therefore not automatically a treaty resident of that state.

For dual-resident individuals, the treaty tie-breaker must be applied before benefits are claimed.

3. The residence certificate is the practical gateway to Turkish treaty relief

Revenue Administration rulings repeatedly state that a foreign taxpayer seeking treaty treatment should provide an official residence certificate issued by the competent authority of the foreign state.

The certificate demonstrates that the person is fully liable to tax as a resident in that country for the relevant period. A utility bill, passport or ordinary address certificate is not normally a substitute for an official tax-residence certificate.

Obtain the certificate before payment where reduced withholding is expected.

4. Turkish use can require the original certificate and certified Turkish translation

GİB practice has required the original residence certificate together with a Turkish translation certified by a notary or Turkish consulate in the relevant foreign state in the circumstances described by the rulings.

Treaty, apostille and administrative practice can affect exact formalities. The payer/tax office should be asked what current form it accepts.

Names, tax numbers and residence period must match the payment recipient.

5. A residence certificate should cover the income period

Residence can change from year to year. A certificate relating to 2024 should not be assumed to prove treaty residence for a 2026 payment unless the competent authority or applicable procedure treats it as valid for that period.

Recurring payers should maintain current certificates.

Changes in residence, corporate seat or management should be disclosed before relying on an old treaty file.

6. Individuals can use treaties for salary, rent, pensions, investment income and gains

The applicable article depends on income character. A person resident abroad receiving rent from Turkish real estate will usually face a different treaty rule from a person performing employment services in Türkiye.

The person’s domestic tax residence should be established first, then treaty residence and source rules applied.

Our tax-residency guide explains the domestic/tie-breaker framework.

7. Foreign companies also need residence evidence

A foreign corporation receiving payments from Türkiye can need to prove that it is a resident of the treaty state and, for some treaty benefits, the beneficial owner of the income.

Certificate of incorporation alone does not always prove treaty residence. The relevant foreign tax authority’s residence certificate is the stronger document.

Permanent establishment and place-of-effective-management issues can alter the analysis.

8. Treaty dividend articles can cap Turkish withholding

Turkish domestic law imposes withholding on specified dividend distributions. A treaty can reduce the maximum source-state rate for a qualifying foreign resident, often depending on shareholding conditions.

The exact percentage varies by treaty and sometimes by ownership percentage. Do not apply one universal treaty rate.

Residence and beneficial ownership evidence should be available to the Turkish distributing company.

9. Interest articles can limit source taxation but contain exceptions

Interest paid from Türkiye to a foreign resident can be subject to domestic withholding. The treaty may cap the Turkish tax or allocate exclusive rights in particular public-sector/financial cases.

If the debt claim is effectively connected to a Turkish permanent establishment, the business-profits article can replace the ordinary interest article.

Loan agreements and lender status therefore matter.

10. Royalty classification is critical

Payments for trademarks, patents, know-how, copyright or software can fall under a treaty royalty article, while a pure service or sale of standard software may be classified differently.

The contract’s substance controls more than its invoice label.

A wrong classification can produce incorrect withholding even if the residence certificate is valid.

11. Business profits are generally linked to permanent establishment

Many treaties allow Türkiye to tax the business profits of a foreign enterprise only to the extent attributable to a permanent establishment in Türkiye.

Whether a fixed place, branch, dependent agent, construction site or service presence creates a PE depends on the exact treaty and facts.

A foreign company should review PE risk before assuming invoices can be paid gross under the business-profits article.

12. Employment articles commonly use presence and employer tests

Cross-border salary can be allocated through a treaty’s employment article, often using physical work location, a day-count threshold, employer residence and whether remuneration is borne by a permanent establishment.

The familiar 183-day condition is a treaty employment test in many agreements, not the same thing as Turkish domestic tax residence.

Remote workers should distinguish the two analyses.

13. Turkish immovable-property income is usually taxable in Türkiye

Most treaties preserve the right of the country where immovable property is situated to tax rental income from that property.

A foreign residence certificate therefore usually does not make Turkish apartment rent tax-free. It supports treaty coordination and double-tax relief.

Our non-resident rental tax guide explains the Turkish rules.

14. Gains from Turkish immovable property are also commonly taxable in Türkiye

Treaties generally allow the situs state to tax gains from direct disposal of immovable property. Some agreements also contain rules for shares deriving substantial value from immovable property.

Domestic holding-period and exemption rules are then applied within that taxing right.

The specific treaty should still be checked.

15. The residence state normally eliminates double taxation through credit or exemption

Where both states may tax the same income, the treaty’s elimination-of-double-taxation article normally requires the residence state to give a credit for Turkish tax or exempt the income, subject to its method.

Keep Turkish withholding certificates, tax returns and payment receipts. Without proof of Turkish tax, the foreign authority can refuse the credit.

The relief cannot usually exceed the treaty/domestic limits applicable in the residence state.

16. Missing a residence certificate can lead to domestic withholding first and refund work later

GİB practice states that where treaty residence is not proved, domestic law can be applied. Depending on the facts and procedure, the foreign recipient may later seek correction/refund after producing treaty evidence.

That route is slower and creates cash-flow cost. Preparing the certificate before payment is preferable.

Refund applications should reconcile the Turkish payer’s declarations and the foreign recipient’s identity.

17. Dual residence must be resolved before claiming one country’s treaty benefits

If domestic law treats an individual as resident in both countries, treaty tie-breakers typically examine permanent home, centre of vital interests, habitual abode and nationality.

A residence certificate from one state is important evidence but the treaty analysis can still require the full factual test where dual residence is disputed.

Conclusion

Treaty relief is a documentation-and-classification exercise. First prove treaty residence with the appropriate residence certificate, then classify the income, apply the exact treaty article and keep evidence for any foreign-tax credit. Without residence proof, Turkish domestic withholding can be applied even where a treaty would otherwise reduce the tax.
