Foreigner Arrested or Detained in Turkey: Custody Time, Lawyer, Interpreter and Consular Rights

Arrest and Detention Rights in Turkey: Legal guide for foreigners arrested in Turkey: CMK custody limits, lawyer and interpreter rights, consular contact, statement procedure and challenge to detention.

A foreigner arrested in Türkiye is protected by the same core Criminal Procedure Code safeguards as a Turkish suspect, with additional language and consular considerations. Under CMK Article 91 and the Arrest, Custody and Statement Regulation, ordinary police/prosecutorial custody cannot exceed twenty-four hours from arrest, excluding the necessary transfer time to the nearest judge or court, which cannot exceed twelve hours. In collectively committed offences, the public prosecutor can order extensions under the statutory conditions, each no longer than one day and within the total extension framework. A detained foreigner should be informed of the accusation and rights, can receive legal assistance, has a right to interpretation where unable to understand Turkish, and can seek consular communication under applicable international and domestic rules.

Request criminal-law assistance: Give the police station or authority, the person’s name, arrest time if known, file reference and language needed. A family member can use the office’s contact channel to request a review. Call +90 552 224 43 66 · English-speaking legal assistance in Turkey.

1. Arrest and custody are different procedural stages

Arrest is the immediate deprivation of liberty based on a lawful arrest ground. Custody follows when the public prosecutor concludes that continued detention is necessary for the investigation within the statutory conditions.

A foreign visitor can be arrested at an airport, hotel, road checkpoint, police station or another location. The same legality requirements apply regardless of nationality.

The legal file should record the exact arrest time because custody calculations start from that event.

2. Ordinary custody is limited to twenty-four hours

CMK Article 91 provides the ordinary maximum period for a person taken into custody after arrest. The investigation should be completed as quickly as possible; the maximum period is not a default waiting time.

A suspect whose necessary procedures finish earlier should be released or referred without waiting for the clock to expire.

The custody order and time calculations should be examined where liberty is challenged.

3. Necessary transfer time to the nearest judge or court cannot exceed twelve hours

The law separates custody from the physical time reasonably needed to reach the competent judge or court. That transfer allowance cannot be used as additional investigation time.

Long-distance geography can justify some travel time, but the statutory ceiling remains relevant.

Transport records and referral times should be preserved.

4. Collective-offence custody extensions require a written order

Under CMK Article 91(3), difficulty collecting evidence or a large number of suspects in a collectively committed offence can justify written prosecutor-ordered extensions of no more than one day each, up to three additional days. The extension must be notified immediately. A serious allegation alone does not establish these conditions.

5. Prosecutorial control and the limited police-chief exception

Ordinary custody is subject to prosecutorial control. Article 91(4) provides a specific exception for designated police chiefs in listed offences caught in the act, with separate 24/48-hour conditions, reporting duties and judicial-presentation limits. Police do not have an unrestricted power to extend custody. Counsel should check the arrest time, decision-maker, offence, written orders and applicable paragraph before calculating the deadline. See the official Criminal Procedure Code, Article 91.

6. The foreign suspect must be informed of the accusation and procedural rights

A person cannot defend effectively without knowing why liberty was restricted. Information should be given in a manner the person can understand.

The record should show the offence under investigation and the principal procedural rights.

Signing a Turkish-language form without understanding it does not make meaningful interpretation unnecessary.

7. Legal assistance should begin before substantive questioning

Under CMK Article 150(1), a suspect or accused who states that they are unable to select defence counsel can request an appointment. Mandatory-defence cases under Article 150(2)–(3) do not depend on a request. Ask the custody authority to record the request before questioning. Appointment through the criminal-procedure system is separate from privately retaining a lawyer and agreeing professional fees. See the Ministry’s published CMK provisions, Article 150.

Foreign embassies often maintain lawyer lists, but the lawyer is independent from the embassy and the criminal authorities.

Counsel should obtain the custody timeline, allegation, available file access and planned investigative acts.

8. A suspect who cannot understand Turkish has interpretation rights

CMK Article 202(1)–(3) protects participation through an appointed interpreter where Turkish is insufficient to understand and express the person’s case, including during the investigation. Under Article 324(5), the State Treasury bears the cost of an interpreter appointed for a person who does not know Turkish; that expense is not treated as a recoverable trial cost. This explanation concerns the statutory language safeguard, not every privately commissioned translation or other language service. See CMK Article 324(5).

The interpreter should translate the substance, not merely ask the suspect to sign prepared answers.

Errors in interpretation should be placed on the record immediately.

9. Consular communication is a separate protection for foreign nationals

Under the Vienna Convention on Consular Relations and applicable procedure, a detained foreign national can have consular notification/communication rights. The exact operation can depend on the person’s wishes and applicable bilateral rules.

The consulate can assist with family contact, document verification and lawyer information but does not control the Turkish criminal case.

Dual Turkish nationals can present different consular issues and should be assessed individually.

10. The first statement can shape the entire criminal file

Foreign suspects should not treat police questioning as an informal conversation. Statements are evidence governed by CMK safeguards.

The suspect should understand the allegation, consult counsel and correct any inaccurate translation before signing.

Guessing facts to satisfy the interviewer can create contradictions later.

Can a police statement taken without a lawyer be used as the basis for judgment?

CMK Article 148(4) prevents a police statement taken without defence counsel from being used as the basis for judgment unless the suspect or accused confirms it before a judge or court. The rule concerns police questioning; it should not be treated as a blanket description of every document or prosecutorial act in the file. Keep the statement, interpreter record, counsel details and any later judicial statement together so the applicable safeguard can be assessed.

Legal basis: the Constitutional Court’s official publication of CMK Article 148(4), paragraph 24. This statutory explanation does not predict how a court will assess the particular evidence.

11. The right to remain silent must be distinguished from refusal to identify oneself

A suspect has the right not to make self-incriminating substantive statements. Identity information is treated separately under procedure.

Counsel can advise whether answering particular factual questions is strategically appropriate.

Silence should not be replaced by a fabricated story.

12. Personal property and digital devices should be documented when seized

Passport, telephone, laptop, cash and other items can be taken into custody or seized under different legal bases. The suspect should receive or preserve an inventory/record.

A digital search or copying operation requires its own legal authority and should not be confused with merely storing the device while the person is detained.

Return requests can be made when the legal basis ends.

13. Arrest and custody can be challenged before the competent judge

The arrested person, counsel and other persons identified by law can seek judicial review of arrest, custody or extension. The aim is immediate release if the measure is unlawful.

The application should address the actual defect: no legal ground, expired time, disproportionality or another procedural violation.

Separate compensation remedies can arise later for unlawful deprivation of liberty under CMK conditions.

14. Release can occur before any judge referral

If the prosecutor concludes that custody is unnecessary or evidence does not justify continued restriction, the person can be released.

Release from criminal custody does not automatically resolve an independent immigration detention or removal issue.

A foreigner should therefore verify whether Migration Management has issued a separate administrative measure.

15. If detention or judicial control is sought, the case moves to a judge

The prosecutor can request pre-trial detention or judicial control. A judge then examines statutory conditions and hears the suspect with defence assistance.

The judge is not simply extending police custody; a new judicial decision is required.

Our separate guides explain detention and travel-ban measures.

16. A criminal allegation can create immigration consequences, but the systems are separate

A foreigner can simultaneously face a criminal investigation and an administrative immigration process. A conviction is not required for every immigration measure, but the legal grounds and remedies differ.

Deportation decisions should be challenged under Law No. 6458 rather than only through the criminal file.

Our deportation appeal guide explains the seven-day route.

17. Family contact should be organised through lawful notification channels

Detention creates immediate practical problems for travel companions, children, employers and family abroad. Authorities have notification procedures, and counsel can coordinate lawful communication.

Family members should avoid posting unverified accusations or evidence publicly while the investigation is active.

Conclusion

A foreigner arrested in Türkiye should focus immediately on time, language, lawyer access, the exact accusation and whether a separate immigration measure exists. Custody is strictly time-limited and subject to prosecutorial/judicial control. Early procedural accuracy is often more important than trying to give a detailed substantive defence before the person understands the case file.
