Renouncing an Inheritance in Turkey from Abroad: Deadlines, Debts and Conduct
Rejecting an inheritance from abroad requires a decision about the estate, a deadline check and a valid court declaration. This guide explains the Turkish rules and the documents to prepare before instructing a lawyer.

Can an heir abroad reject an inheritance connected with Turkey?
Yes, where the applicable Turkish inheritance rules govern, an eligible heir can make an unconditional renunciation through the civil court of peace procedure. Article 606 of the Civil Code sets an ordinary three-month period, but its starting point must be identified for the particular heir. Living abroad does not automatically extend it. Conduct involving the estate can also affect the right, so do not distribute assets first and ask about renunciation afterwards.
This guide concerns rejection after death, not a lifetime inheritance-waiver agreement or a sale of an inheritance share. Our English legal services homepage explains representation coordinated from our Mersin office.
Four checks before making a decision
| Check | What must be established |
|---|---|
| Applicable law | The deceased’s nationality, relevant assets and cross-border succession rules. |
| Deadline | The legally relevant knowledge or notification date, not simply the date a document was translated. |
| Estate conduct | Any withdrawal, transfer, management, concealment or protective action already taken. |
| Effect | The position of other heirs, descendants, creditors and any independent personal obligation. |

1. Establish which succession rules govern the decision
A Turkish asset, a foreign passport and residence overseas do not combine into one automatic rule. Article 20 of Law No. 5718 starts from the deceased’s national law for succession, specifies Turkish law for immovables situated in Turkey and separately addresses acquisition and division by reference to the location of the estate. Identify those connections before treating a foreign renunciation as effective for every Turkish purpose.
Provide the deceased’s nationality or nationalities, last residence, date of death and a preliminary description of the assets and debts. A relative’s current nationality is not a substitute for the deceased’s relevant status. Where more than one succession system is involved, obtain advice about the relationship between the procedures instead of filing inconsistent statements in different countries.
A document validly executed abroad can still require authentication, translation or a particular Turkish procedural step. Its form and substantive effect are separate questions. Do not assume that obtaining an apostille itself rejects the inheritance, or that a foreign court’s description of heirs resolves every issue about Turkish immovable property and creditor responsibility.
2. Understand what is being rejected, not only which debt is feared
Article 599 of the Turkish Civil Code provides for succession as a whole and personal responsibility for inherited debts subject to the statutory exceptions. The renunciation decision therefore concerns the inheritance position, not a unilateral cancellation of whichever creditor has recently sent a letter.
Prepare a preliminary estate account showing known assets, liabilities and uncertainties. A house with an attractive market value can be subject to security or other relevant claims. Conversely, the existence of a debt does not establish that the estate has no positive value. Identify the ownership share actually belonging to the deceased rather than counting the entire family property.
Do not draft a statement that purports to retain the desired apartment while disclaiming all liabilities attached to the inherited position. The legal effect of a renunciation, any separately acquired right and any distinct legacy must be examined accurately. A repayment negotiation with one creditor is not the same act as rejecting the inheritance through the statutory process.
3. Calculate the three-month period from the correct event
Article 606 gives legal heirs three months beginning when they learn of the death, unless later knowledge of their heirship is proved. For heirs appointed by a will, the provision uses formal notification of the testamentary disposition. The chronology must identify which category applies instead of assuming that every family member has an identical starting date.
Keep evidence of the relevant communications and notifications. The date a death certificate was issued, the date it was translated and the date a bank contacted the heir are not automatically the statutory starting point. Someone who already knew of the death should not assume that waiting for an heirship certificate prevents the period from running.
Calculate calendar months under the applicable rules rather than replacing three months with an arbitrary ninety-day approximation. Supply actual dates for legal review and avoid publishing a supposed universal filing date from an incomplete family narrative. A short deadline makes early document organisation important, but it does not justify inventing certainty where the knowledge or notification event is disputed.
4. Identify special starting rules and extensions without assuming them
Articles 607 and 608 address particular situations involving a protective estate inventory, an heir who dies before exercising the right, and people who become entitled because earlier heirs renounced. These provisions require the actual sequence and relevant notices. A private list prepared by a family member is not automatically the protective court inventory described by the law.
Article 615 permits the civil judge to extend the period or grant a new period for important reasons. It is a judicial assessment, not a routine extra allowance for every person living outside Turkey. Explain the obstacle, its dates and evidence rather than treating an overseas address as conclusive proof of entitlement to more time.
A request for time and a completed renunciation are different procedural acts. Do not assume that an unanswered enquiry or an informal request to a relative protects the position. Identify the required filing and any decision actually made. Where the period appears to have expired, review the facts and the distinct legal routes promptly instead of automatically backdating a statement.
5. Make the declaration through the appropriate court process
Article 609 provides for an oral or written declaration to the civil court of peace and requires it to be unconditional. The judge records the declaration, and a timely renunciation is entered in the special register through the court where the inheritance opened. Establish the relevant court and procedural route for the actual succession.
A letter to a bank saying that the heir does not wish to pay is not automatically the statutory declaration. Nor should an unsigned draft on a laptop be treated as proof of filing. Keep the submitted document, filing evidence, court record and any certificate supplied following registration.
The declaration should identify the heir and deceased accurately and avoid unnecessary conditions or a contradictory account of acceptance. Where a representative acts, ensure the authority specifically covers the act being performed. An appointment to obtain estate information should not be assumed to authorise an irreversible renunciation without the client’s informed instruction.
Documents to prepare while abroad
| Information or document | Why it is needed |
|---|---|
| Heir’s identity, contact details and family link | To identify the person making the declaration and the basis of heirship. |
| Death record, deceased’s nationality and last residence | To assess succession law, the relevant court and the death chronology. |
| Messages about the death, will notification or earlier renunciation | To establish the applicable starting event; keep the original dates and records. |
| Known property, bank balances, loans and enforcement files | To compare assets and debts without assuming that a single demand describes the whole estate. |
| Receipts and records of estate dealings | To assess withdrawals, rent, transfers or protective management already undertaken. |
| Power of attorney and any required authentication/translation | To establish the representative’s authority for the intended act. |
| Court and enforcement notices, including service records | To identify separate response deadlines that a renunciation enquiry does not suspend. |
This is a preparation list, not a promise that every court will require identical documents. Mark missing records clearly and arrange the deadline review before waiting for the complete file.
7. Examine estate dealings already undertaken
Article 610 addresses loss of the right where an heir intervenes in estate affairs beyond ordinary management or necessary conduct, conceals estate assets or appropriates them. An heir should therefore disclose withdrawals, transfers, sales, leases and other dealings honestly before asking counsel to file a rejection.
The same article distinguishes action taken to prevent limitation or forfeiture periods from expiring. Protective action is not automatically equivalent to taking the inheritance for personal benefit. The legal assessment depends on what was done, why, with which authority and what happened to the money or property.
Do not assume that every administrative enquiry destroys the right, or that every transaction described as helping the family is harmless. Preserve receipts, instructions and the destination of funds. In particular, actual collection and use of rent deserve examination alongside the inherited rental-income account, rather than being omitted from the chronology.
8. Keep presumed rejection of an insolvent estate distinct
Article 605 also provides for the inheritance to be treated as rejected where the deceased’s inability to pay at death was openly apparent or officially established. That is a distinct basis from an heir’s ordinary timely declaration. It should not be reduced to a promise that any large debt discovered later makes every missed deadline irrelevant.
The financial position at death matters. Identify assets, liabilities, enforcement records and other evidence addressing that date. A current empty bank account does not by itself establish the entire historical estate position. Equally, a creditor’s assertion that valuable assets existed should be tested against the records rather than accepted without review.
When this basis is disputed, the necessary declaration, defence or proceedings and proper parties require individual assessment. Do not ignore a served payment order while assuming that the estate’s financial difficulty automatically stops every enforcement step. The creditor’s claim and the inheritance-law position must be handled through the appropriate procedures.
9. Check the effect on other heirs and children
The consequence depends on who rejects, not simply on how many family members sign a statement. Under the Turkish Civil Code, these situations must be separated:
| Situation | Statutory consequence |
|---|---|
| One legal heir rejects — Article 611 | The share passes as if that heir had not been alive when the succession opened. Identify who benefits under the actual family tree. |
| All nearest legal heirs reject — Article 612 | The civil court of peace liquidates the estate under bankruptcy provisions. Any surplus goes to the persons entitled as if they had not rejected. |
| All descendants reject and a surviving spouse exists — Article 613 | The descendants’ shares pass to the surviving spouse. |
| Earlier heirs request an offer to subsequent heirs — Article 614 | The judge notifies the subsequent heirs; failure to accept within one month results in deemed rejection under that procedure. |
An appointed heir’s rejection has a separate rule in Article 611, including the deceased’s contrary testamentary intention. Establish the heir category and any will before relying on the table.
The position of descendants requires attention, including any person who becomes entitled following earlier renunciations. An adult’s declaration does not automatically perform every act necessary for a child. Capacity, parental authority, conflicts of interest and any required judicial approval must be assessed for the particular family.
Keep the declarations and dates for each person separate. A family can instruct one lawyer for compatible interests, but a single message saying that everyone refuses the estate is not a substitute for each legally required act. Explain whether the proposed representation covers the adult alone or also another person whose authority and interests need independent consideration.
10. Do not confuse inherited liability with your own obligation
An heir may also have signed a personal guarantee, borrowed jointly with the deceased or entered a separate agreement after death. Rejection of the inheritance does not automatically erase an independent obligation owed in that person’s own capacity. Identify the signature, agreement and legal basis asserted by the creditor.
Articles 617 and 618 also protect specified creditor interests, including certain harmful renunciations and qualifying value received from an insolvent deceased before death. These provisions mean that renunciation should not be promoted as an unrestricted method of removing every possible creditor claim.
Provide relevant prior transfers and existing personal debts candidly. The review should distinguish an ordinary inheritance decision from a challenged transaction or a separate guarantee. Do not conceal property, fabricate receipts or move assets to create a false financial picture. A legally effective response depends on accurate facts and the applicable statutory conditions.
11. Continue responding to formal notices after filing
Preserve the renunciation record and provide it through the appropriate process when a creditor proceeds on an inconsistent assumption. A court registration and a bank’s internal account update are different events. Do not assume that every creditor or enforcement office automatically receives and applies the relevant information without any action.
Read each notice for its sender, file number, date of service and required response. The court documents received abroad guide explains why the service chronology matters. Sending the notice to a relative without confirming the necessary step is not reliable deadline management.
A lawyer’s instruction should identify whether the task is renunciation alone or also responding to an existing creditor proceeding. Those are different work items. A completed filing in one matter should not be reported as resolution of every related enforcement dispute when the other file has not been examined.
12. A hypothetical overseas heir with incomplete estate information
Consider an illustrative heir living in England who learns of a parent’s death and later receives a Turkish bank demand. The heir has not sold assets but has asked another relative to collect property documents. This is an invented example, not a client story or a prediction of a court decision.
The initial review records when the death and heirship were learned, the nature of any estate dealings and the demand’s service date. It identifies the governing succession rules and prepares a preliminary asset-and-debt account. It does not assume that the bank letter is necessarily the first legally relevant date.
The next decision separates a timely unconditional declaration, any genuinely applicable special rule and a defence concerning the creditor’s claim. The benefit of the chronology is that each issue can be assessed without treating a foreign address, an unknown debt and a missing heirship certificate as interchangeable reasons for postponement.
13. Arrange a review and court filing from abroad
- Confirm the immediate dates: Record death/notification knowledge, any earlier renunciation and the service date of each creditor notice.
- Review the estate and conduct: Identify known assets, debts, prior transactions and any independent guarantee or borrowing.
- Decide the legal route: Assess a timely declaration, a supported request for additional time or a distinct insolvency issue.
- Complete authority: Agree the mandate and obtain the power of attorney and required document formalities for that route.
- File and retain proof: Keep the court submission, filing record and registered renunciation document; identify any separate enforcement response still needed.
For the initial enquiry, prepare the short chronology and the documents listed above, including records that are still incomplete. State the country you live in, your contact number and time zone.

Frequently asked questions
Does living abroad automatically extend the period?
No. The statutory starting point and any exceptional judicial relief require individual assessment.
Does the period always begin when I obtain an heirship certificate?
No. Article 606 uses the relevant knowledge or formal notification event.
Is a letter to the creditor enough?
Do not treat it as the statutory court declaration. The correct filing and record must be established.
Can I take the desired assets and reject only the debts?
A renunciation is not a unilateral selection of favourable assets while disowning the corresponding inheritance position.
Does every protective act mean acceptance?
No. Article 610 distinguishes specified protective conduct from dealings inconsistent with rejection.
Does my declaration automatically cover my child?
No. The child’s position, authority and any required approval must be assessed separately.
Does rejection erase a personal guarantee?
Not merely because the guaranteed borrower was the deceased. An independent obligation requires separate review.
Does emailing the office preserve a legal deadline?
No. An enquiry does not establish representation or perform the necessary procedural act.
