Turkey Student Residence Permit 2026: Articles 38–41, Work Rights and University Changes

A student residence permit in Türkiye is governed by Articles 38–41 of Law No. 6458. It is available to qualifying foreign students in primary/secondary education who need a permit and to foreigners enrolled in associate, undergraduate, graduate, doctoral, medical-speciality or dentistry-speciality programmes. The permit is tied to genuine continuing education. It does not itself authorise employment: foreign students must obtain a work permit, and associate/undergraduate students may exercise their statutory work right only after the first year, subject to the current weekly-hour limit.

1. Student residence is a specific education-based status

Article 38 regulates the foreign students who can receive a student residence permit. The status covers qualifying primary/secondary pupils who do not already benefit from a family residence permit and foreigners studying in Turkish higher education at associate, bachelor, master, doctorate, medical-speciality (TUS) or dentistry-speciality (DUS) level.

The permit is not available simply because a person takes any private course. The education must fall within the categories recognised by the law and implementing regulation. Language courses, internships, exchange programmes and other educational activities can fall under other residence grounds depending on the programme.

Before applying, the student should identify the exact education programme and institution shown in official records. The e-Residence application should use that status consistently rather than a generic description such as “student in Turkey.”

2. Primary and secondary education has age and parental-consent rules

Foreign children holding a family residence permit can continue primary and secondary education without a separate student residence permit until age 18. A student over 18 who continues at secondary level requires an appropriate residence permit.

Where a foreign primary/secondary student does not have family residence, student residence can be issued with the consent of the parent or legal guardian and evidence concerning care and expenses. The official framework permits one-year permits to be issued and renewed during the education period for this category.

Custody and guardianship documents issued abroad should be legally usable in Türkiye. If parents are divorced, the authority may need reliable evidence showing who can consent to the child’s residence and education.

3. Higher-education enrolment is the central factual basis

Associate, undergraduate, graduate, doctoral, TUS and DUS students can receive student residence permits when the statutory conditions are satisfied. The enrolment record must correspond to a recognised Turkish higher-education institution and active programme.

An acceptance letter before final enrolment and an active student record can serve different administrative purposes. Applicants should follow the document list applicable at the filing stage and ensure that university records have been transmitted correctly where the current system relies on institutional data.

Suspension, deregistration or failure to continue studies can later affect the permit because the immigration status is linked to education.

4. The permit can be tied to the full education period

Current Migration Management guidance states that a residence permit may be issued for the period of study for qualifying students. Where the education period is less than one year, the residence permit cannot exceed the study period.

The printed expiry date should not be interpreted as permission to remain a student after enrolment has ended. If the education relationship terminates earlier, the legal basis can disappear before the card’s nominal expiry.

Students should also check passport validity. Residence authorisation cannot be planned beyond the documentary limits imposed by immigration rules.

5. Article 39 requires education evidence, admissibility and a Turkish address

Article 39 requires the foreigner to submit information and documents relating to the Article 38 education purpose, not fall within Article 7 entry restrictions and provide an address in Türkiye.

The address should reflect actual accommodation. Dormitory, rented housing and family accommodation can require different evidence. A nominal address used only to complete an online form creates avoidable risk.

Identity information should be consistent across passport, university records and immigration documents. Name-order differences or transliteration errors should be corrected early so enrolment and residence databases refer to the same person.

6. Students have a specific three-month general health insurance opportunity

Migration Management states that no separate private health insurance is required where the student requests general health insurance under Turkish social-security rules within three months from admission. If the student does not make that request within the three-month period and loses the opportunity to be covered on that basis, private health insurance satisfying the immigration requirements is required.

This rule should not be confused with merely holding travel insurance used for entry. Residence insurance must satisfy the applicable Turkish requirements for the permit period.

Exchange-programme students can also be affected by SGK registration rules. University international offices and the current official immigration instructions should be checked together.

7. A student residence permit does not itself authorise employment

Foreign students at associate, undergraduate, graduate and postgraduate level may work only after obtaining a work permit. For associate and undergraduate students, the statutory work right begins after completion of the first year of study.

Current Migration Management FAQ states that associate/undergraduate students’ weekly working hours may not exceed 24 hours. Graduate-level work is still subject to work-permit law even though the first-year restriction applicable to associate/undergraduate students is different.

Our Turkey Work Permit 2026 guide explains employer criteria and permit requirements. A student should not work informally on the assumption that enrolment alone protects against labour and immigration sanctions.

8. Faculty, department and institution changes must be reported correctly

Official guidance states that a faculty or department change within the same educational institution, or an institution change within the same province, can preserve the existing student residence permit where studies continue without interruption and notification is made on time.

If the existing permit expires before the new study period ends, an extension must be processed under the applicable procedure. The university change should be visible in the immigration record.

A student should not continue using a residence card whose underlying university record still shows an institution from which the person has withdrawn.

9. Moving the education to another province requires a new provincial residence process

Where the student continues education in a different province, Migration Management states that the current residence permit is cancelled and a new permit valid for the education period is issued by the governorate in the new province.

This is more than an address change. The competent provincial migration authority changes together with the educational location.

The student should coordinate school transfer, accommodation, address registration and residence procedures so there is no unexplained gap.

10. Graduation ends the education basis and requires a timely transition

Migration Management’s FAQ states that the student residence permit is cancelled as of graduation and the graduate must apply for a residence permit suitable for the new purpose of stay within ten days.

A person intending to remain for employment should assess the work-permit route rather than wait for the old student card’s printed date. A graduate who has a different lawful residence purpose should choose the permit category that actually matches that purpose.

Article 31 also contains a short-term residence route for certain graduates who apply within the statutory period after completing higher education in Türkiye. That is a separate legal basis from continuing student residence.

11. Open education and distance education do not create student-residence eligibility by themselves

Migration Management expressly states that private-student, open-education and distance-education status does not qualify a foreigner for a student residence permit on that ground. The person must apply for another residence type whose conditions are genuinely met.

This is important for students who study largely online while living in Türkiye. The immigration status follows the statutory categories, not the marketing description of the educational programme.

If a programme changes from in-person qualifying education to a non-qualifying format, the student should review residence status immediately rather than wait until renewal.

12. Student residence gives limited sponsorship rights for spouse and children

Official guidance states that a student residence permit allows the student to be a supporter for the spouse and children in family-residence applications. It does not create a residence right for other relatives.

The family residence application remains subject to its own statutory requirements. The spouse or child does not receive student residence merely because the principal student is enrolled.

Where a child is born during the student’s stay, birth registration, passport/nationality and residence documents should be arranged through the applicable civil-status and immigration procedures.

13. Article 40 sets refusal, cancellation and non-renewal grounds

A student permit is refused, cancelled or not renewed where Article 39 requirements are not met or cease to exist; where evidence shows the studies are unlikely to continue; where the permit is used for another purpose; or where a current removal decision or entry ban exists.

The administration should connect the decision to the actual facts. A temporary academic difficulty should not automatically be described as permanent abandonment without reviewing the university record. Conversely, formal enrolment with no genuine continuation can support an adverse assessment.

Students receiving a refusal should obtain the full written decision and notification rather than rely on a university-office summary.

14. A strong application reconciles university and immigration records

Prepare the passport, student/enrolment evidence, address record, insurance/SGK evidence, photographs and any parental/custody material required for the category. The current e-Residence document list should be checked at filing because administrative document formats can change.

Foreign civil-status records can require apostille or other legalisation and Turkish translation. Our foreign-document authentication guide explains the formalities.

Keep copies of every application form and submission record. University changes and graduation dates should be documented so later immigration questions can be answered chronologically.

15. A refusal can be challenged as an administrative act

A student-residence refusal is subject to administrative-law review. Unless a special period applies to the particular act, the general administrative-court filing framework must be calculated from written notification.

Our Turkey Residence Permit Rejection Appeal guide explains the ordinary sixty-day litigation framework and the distinction from the seven-day deportation deadline.

Conclusion: maintain the education basis throughout the permit period

A Turkey student residence permit is an education-based status under Articles 38–41, not a general residence card for anyone enrolled in a course. Qualifying students must keep active study, address and documentary conditions aligned with immigration records. Work requires separate authorisation; university/province changes must be reported correctly; and graduation requires a timely move to a new lawful status where the person intends to remain.
