Missed Court Deadlines in Turkey: Restoration of Time for Clients Abroad
Can a missed civil court deadline be restored?
Missed court deadlines in Turkey require immediate identification of the omitted act and the reason it was not completed. Articles 95–101 of the Code of Civil Procedure regulate eski hâle getirme, a request to restore the opportunity to perform a procedural act prevented by circumstances outside the applicant’s control. It is a conditional remedy, not a routine extension for every late filing.

Article 96 ordinarily requires the request within two weeks after the obstacle disappears. Article 97 also requires the missed act to be performed within the application period. A letter explaining an emergency without completing the required procedural step does not necessarily satisfy the statutory requirements.
This guide addresses Turkish civil proceedings. Criminal, administrative, enforcement-specific and substantive limitation rules must not be treated as identical. Our English legal services homepage explains how matters across Turkey are coordinated from Mersin. No particular deadline is restored merely because the party lives abroad or instructs an English-speaking lawyer.

| What was missed? | Identify the specific procedural act, applicable period and court order. |
| Why was it missed? | Explain the obstacle and its connection with the inability to act, using genuine evidence. |
| When did the obstacle end? | Article 96 ordinarily requires the application within two weeks of that event. |
| What else must be done? | Article 97 also requires completion of the missed act within the application period. |
| Does the case stop? | A restoration request does not automatically suspend proceedings or enforcement. |
1. Identify the act and the legal period before calculating lateness
Obtain the document requiring action and state precisely what had to be done. Filing a defence, answering an expert report, submitting an exhibit and bringing an appeal are different procedural acts. A client’s recollection that the court gave two weeks is not enough to identify the starting event, the legal basis or the consequence of failure.
Articles 90–94 distinguish statutory periods from those fixed by a judge and regulate their calculation and binding effect. The 2020 amendment to Article 94 requires a judicial peremptory direction to identify the act clearly and record the warning about non-compliance. Check the actual order rather than assuming that every informal reference to a date has the same effect.
A substantive limitation period for a payment claim is not automatically a procedural period capable of restoration under these articles. Nor does the procedure revive every separate right that has expired. Classify the problem first. Otherwise, a carefully prepared petition can still seek relief under a mechanism that does not govern the lost opportunity.
2. Reconstruct the notification and calculation
Keep the notice, delivery record, court directions and any representative’s notification together. Article 91 generally ties the start to service, or to pronouncement where the law specifies it. The day a client abroad first reads a translated explanation is not automatically the date that starts the court’s clock.
Article 92 distinguishes periods expressed in days from weeks, months and years. A month should not be replaced with an assumed thirty days. Article 93 also addresses public holidays, including the situation where the final day falls on one. Electronic filing, judicial recess and special statutory rules require any further applicable assessment; do not calculate by a foreign working calendar alone.
Where service is disputed, keep that issue distinct from the alleged obstacle. A challenge that a period never started correctly differs from asking to restore an opportunity after a valid period expired. Counsel should assess how to present and protect those positions without making contradictory factual admissions or assuming that an unresolved service argument permits further delay.
3. Show how the obstacle actually prevented the required step
The application needs a causal explanation, not simply the name of a difficult event. Identify what happened, when it happened, what action was required and why the applicant could not perform it within the relevant period. An event affecting convenience is not necessarily an event preventing the procedural act.
A medical record should be read for what it actually establishes. A consultation receipt, hospital admission and documented incapacity to communicate can have different significance. Provide the relevant dates and functional circumstances without exaggeration. A diagnosis alone should not be presented as automatic proof that every possible action was impossible throughout several weeks.
The same discipline applies to travel disruption or a claimed system failure. Preserve the actual cancellation, error notice or official record and explain its connection to filing or communication. A photograph of an airport queue does not establish that no authorised representative could act. Do not invent a technical outage or a medical limitation to support an otherwise unsupported request.
4. Determine when the obstacle ended
Article 96 measures the ordinary application period from disappearance of the obstacle, not from the day the applicant later decides to seek advice. Record the earliest date on which the relevant barrier ceased and explain the evidence supporting it. A return flight or hospital discharge may be relevant, but neither should be selected mechanically without examining the actual impediment.
Recovery can occur in stages. Someone may remain under treatment after regaining the ability to communicate and instruct counsel. Conversely, leaving a hospital does not necessarily resolve every documented incapacity. The application should explain the actual sequence rather than present a convenient date detached from the reason relied upon.
Record subsequent actions as well. Messages sent, bank instructions completed and meetings attended may be relevant to an assertion that all communication remained impossible. Do not omit inconsistent material. A candid chronology allows the legal team to distinguish the obstacle’s duration from the time later spent assembling a fuller evidential file.
5. Check whether another legal route can achieve the same result
Article 95(2) excludes restoration where the same result remains attainable through another legal route. Identify whether the period truly expired, whether an available ordinary procedural mechanism still permits the act and what result that mechanism produces. A preference for the label restoration does not replace that analysis.
An application for an extension made before an applicable period expires is different from relief sought after it was missed. For example, the court expert report guide explains the particular extension mechanism in Article 281. Its conditions and timing should not be confused with a later restoration request.
This does not mean that every theoretical lawsuit against another person replaces the lost procedural act. Identify the actual alternative and whether it produces the same procedural result contemplated by the provision. The application should explain the available route or the reason it is unavailable, rather than merely assert that restoration is the applicant’s only hope.
6. Complete the missed act as well as requesting relief
Article 97 requires a petition identifying the reasons and supporting evidence or indications. It also requires the omitted act to be performed within the period for requesting restoration. Prepare both components together. A petition asking for permission to draft an appeal at some unspecified later date should not be confused with completion of the appeal step itself.
The required act depends on the file. Identify the pleading, evidence submission, payment or other procedural step involved and examine its own formal requirements. A document prepared in a word processor is not a filed pleading, and a transfer instruction is not necessarily proof that an ordered payment reached the appropriate account.
Keep filing and payment receipts with the submission. Where the missed act has supporting attachments, organise them so the court can identify what was performed and when. Explain any genuine practical difficulty immediately. The application should not quietly substitute an incomplete draft for the procedural act that the statute requires to be completed.
7. Choose the correct court and address the stage already reached
Article 98 ordinarily directs the request to the court that would have examined the omitted act. It separately addresses loss of the right to regional appellate review and cassation, identifying the regional appellate court and the Court of Cassation respectively. The competent destination therefore depends on the missed act, not simply the court whose name appears on the first page of the file.
Article 96 also places a stage-related limit in first-instance and regional appellate proceedings, ordinarily requiring the request before the final decision. It contains a qualification where the final decision was given in a party’s absence and the missed period relates to the investigation stage. The qualification must be examined on its own conditions.
Do not treat a final decision as proof that every remedy is impossible, or as proof that any earlier period can be reopened. Obtain the judgment, hearing record and service documents. Identify the omitted step and the stage when it belonged before selecting the court and requesting a particular procedural consequence.
8. Do not assume that filing the request stops the case
Article 99 provides that a restoration request does not itself require adjournment or prevent enforcement of a judgment. The examining court has a separate power to order appropriate suspension within the statutory framework, with security where required and, where appropriate, without it. A pending request is therefore not the same as an order stopping the proceedings.
Identify any imminent hearing, execution step or payment direction separately. Counsel must assess whether protective relief should be sought and under which conditions. Do not advise a client to ignore an existing obligation merely because a restoration petition has been lodged.
The security for costs guide addresses a different security issue arising from claimant status. A security requirement connected with a requested stay should be read under its own basis. Budgeting and explaining the correct type of security prevents the client from assuming that exemption in one context decides every other protective-measure question.
9. Preserve evidence of the obstacle without disclosing unnecessary private material
An effective evidence package connects each document to a particular assertion. An admission record can establish a date; a further record may explain the relevant incapacity; correspondence can show when communication resumed. Make those connections explicit and identify gaps honestly rather than relying on a large collection of unrelated documents.
Foreign-language records need the applicable Turkish translation. Keep the original and translation together, with dates, names and time zones reconciled. Where a document contains sensitive information unrelated to the obstacle, discuss appropriate presentation with counsel. Publicly posting medical or family records is not a substitute for submitting relevant evidence through the case procedure.
Preserve the source of messages and electronic records as well. The WhatsApp and email evidence guide explains why originals and context matter. A recreated screenshot or altered timestamp creates a separate credibility problem and must never be used to fill an evidential gap.
10. Understand the decision and resulting costs
Article 100 regulates examination of the request and requires the court, when granting it, to identify which procedural acts become ineffective. Granting restoration does not necessarily erase the entire case history. The provision also limits its effects by reference to acts that cannot be invalidated through amendment of the case.
Read the operative decision and any new directions carefully. Identify the act accepted, the procedural steps affected and what happens next. Do not tell the client that the underlying claim has succeeded merely because permission to perform a missed act was restored. The merits still require examination under the relevant substantive and evidential rules.
Article 101 ordinarily places the expenses caused by the restoration request on the applicant, while addressing an opponent’s unfounded objections that increase costs. A favourable procedural decision should not therefore be equated with a promise that the process will cost nothing. Keep the restoration expenses separate from the wider case budget and any eventual final costs order.
11. An illustrative emergency during a response period
Imagine a litigant abroad who was suddenly hospitalised during a response period and later learned that a document had not been submitted. These are invented facts for illustration, not a reported client case or a prediction that hospitalisation always justifies relief.
The first review obtains the court direction, service record and the document that should have been filed. It establishes the relevant medical dates, the actual barrier to acting, the role of any existing representative and when the barrier ceased. The legal team examines the filing period and the availability of another procedural route.
Where restoration is the appropriate application, the petition and the missed procedural act are prepared together within the applicable period. The evidence explains the chronology rather than merely attaching a diagnosis. A separate request is considered if proceedings or enforcement need to be stayed. Every step depends on the proven circumstances; sympathy for the emergency does not replace the statutory conditions.
12. Coordinate urgent instructions from outside Turkey
Send the notice, service record, relevant order and a short chronology first. Identify what was missed and the date the obstacle ended. Do not wait until every background document is translated before disclosing an urgent period. Keep a reliable channel open for decisions about filing, evidence and any protective request.
The power of attorney guide explains preparation of authority from abroad. A first message to a lawyer does not establish that representation has begun or that an application has been filed. Ask for and retain confirmation of the agreed scope and the procedural steps actually completed.

Frequently asked questions
Does living abroad automatically justify restoration?
No. The specific obstacle, its timing and its connection with the missed act must satisfy the statutory conditions.
Is an illness certificate always enough?
No. Examine what the document proves about the actual inability to act and the relevant dates.
When does the ordinary application period start?
Article 96 measures it from disappearance of the obstacle, with the other statutory stage conditions also requiring assessment.
Can I complete the missed act after the request is decided?
Article 97 requires the missed act within the application period. Do not treat the petition alone as sufficient.
Does the request automatically stop enforcement?
No. Article 99 distinguishes the request from any separate court decision granting suspension.
Can it revive every time-barred debt?
No. Substantive limitation and other special periods are not automatically governed by this civil procedural remedy.
Does restoration mean I won the lawsuit?
No. It concerns the procedural opportunity identified in the decision, not automatic success on the merits.
Does sending the documents to the office stop time running?
No. Representation and actual filing must be established separately; an enquiry does not preserve a deadline.
