Package Tour Cancellation and Refunds in Turkey: An English Legal Guide
Can you obtain a refund after cancelling a package tour in Turkey?
Package tour cancellation in Turkey depends on who ended the arrangement, why it ended and when notice was received. Article 16 of the Package Tour Contracts Regulation distinguishes a traveller’s notice at least 30 days before departure from later cancellation. Cancellation by the organiser and substantial changes before departure engage different rules. Do not accept a single statement that every booking is non-refundable, and do not assume that every cancelled holiday produces a full refund plus compensation.

This guide addresses a qualifying package governed by the Turkish framework. A hotel-only reservation, a standalone airline ticket and a tour purchased wholly abroad require separate classification. Start with the actual contract rather than the travel advertisement’s label. Our English legal services home page explains representation coordinated from Mersin.
Choose the correct cancellation category
| Situation | Main legal starting point | Evidence to preserve |
|---|---|---|
| Traveller cancels before departure | Regulation Article 16 | Departure date, delivered notice and contractual deductions |
| Organiser cancels or substantially changes the package | Articles 10–11 | Original itinerary, change notice and response |
| Important services fail during the tour | Articles 12–14 | Immediate complaint, alternatives and actual loss |
| Another eligible traveller takes the place | Article 15 | Transfer notice, eligibility and actual additional costs |
1. Identify a package before applying package-tour rights
Under Article 4 of the Package Tour Contracts Regulation, the arrangement combines at least two of transport, accommodation and other tourism services, sold or promised together at an inclusive price, and lasts longer than 24 hours or includes overnight accommodation. The legal test is not simply whether a website uses the word holiday. Compare what was actually sold, how the services were combined and the duration.
Article 2 also prevents a qualifying package from escaping the rules merely because its component services were invoiced separately. Conversely, independently purchasing a hotel and a flight does not automatically make every supplier the organiser of a single package. Preserve the checkout sequence and booking confirmations where the way the transaction was assembled is disputed.
A family booking raises an additional practical question: who purchased it, who was named to travel and who received the cancellation message? List all affected participants and their connection to the contract. Avoid submitting several overlapping demands for the same payment without explaining whether they concern different entitlements or the same group booking.
2. Build the booking file around promises, not advertising impressions
Keep the brochure, itinerary, payment schedule, accommodation description, transport details and accepted special requests together. Articles 5–8 regulate pre-contract information and the contract copy. A room description, accessibility requirement or agreed departure point can matter more to the dispute than the general destination. Identify the specific promise that influenced the booking and the document in which it appears.
Download the terms that applied when the booking was made. A provider’s current website terms might differ from the version accepted months earlier. Record the booking date, version or confirmation reference rather than assuming that a screenshot taken after cancellation proves the original contract. Include material messages exchanged before payment, particularly where the standard itinerary was varied.
For an English-speaking participant, retain the Turkish documents as well as translations and explanations. A marketing translation and the operative contract are not necessarily identical. Mark discrepancies for review instead of silently correcting them. The purpose of the file is to establish the agreement the parties actually made, including any accepted amendment, not the holiday the participant later hoped had been promised.
3. Cancellation at least 30 days before the start
Article 16(2) provides for repayment without cancellation deductions where notice is given at least 30 days before the package begins, apart from expenses arising from obligatory taxes, duties and comparable legal liabilities. This is not a general permission to retain an agent’s chosen administration percentage. Each claimed exception should be identified and connected to an actual legal obligation.
Calculate the interval using the tour’s contractual start and the effective notice records. The date the traveller began thinking about cancellation is irrelevant. Equally, an unanswered telephone discussion is a weaker basis for establishing the notice than a saved written message with evidence of receipt. Do not leave a borderline calculation until the final evening of the relevant period.
The notice should identify the booking and state that cancellation is being communicated, rather than merely asking what a cancellation might cost. A request for a quotation does not necessarily communicate a final decision. Keep the provider’s acknowledgment and any dispute over timing. Article 16(5) links the ordinary refund period to receipt of the termination notice, making delivery evidence important to both entitlement and payment timing.
4. Later cancellation does not always justify keeping the entire price
For notice less than 30 days before departure, Article 16(3) permits an amount or percentage deduction where the package contract provides for it. Read the clause, its calculation and the facts together. A staff member’s later assertion that all close-to-departure bookings are lost is not a substitute for the applicable contractual provision.
Article 16(4) separately addresses an event the participant could not foresee and prevent despite exercising necessary care, or force majeure. Under that route, the permitted exceptions concern compulsory legal charges and documented, non-refundable payments to third parties. A medical problem or other disruptive event should not be labelled qualifying automatically: establish the chronology, actual effect on participation and supporting evidence.
Ask the organiser to explain a third-party deduction with the payment document, relevant cancellation condition and evidence that reimbursement is unavailable. A supplier quotation is not necessarily proof of a payment already made. A refundable hotel amount should not be presented as irrecoverable without explanation. At the same time, the traveller should provide genuine evidence of the event rather than inventing a reason to avoid an otherwise applicable contractual deduction.
5. Separate your cancellation from the organiser’s cancellation or substantial change
Articles 10 and 11 address significant pre-departure changes and cancellation by the organiser. They give the participant choices, including specified alternative arrangements or withdrawal, rather than treating every refusal of a replacement as an ordinary change of mind. Where the applicable withdrawal route is exercised, the regulation provides for repayment within 14 days without a deduction.
Compare the original package with the proposed replacement in a short table. Record accommodation, dates, departure airport, transport, included services and accepted special requirements. The fact that the replacement has the same advertised star rating does not answer every question about whether the relevant contractual elements changed. Identify the real difference without exaggerating a minor scheduling adjustment into a completely different holiday.
Respond clearly to the proposal and preserve the response. Accepting a replacement, reserving a claim about a specific difference and rejecting the substitute are different decisions. Do not accept a voucher without reading its expiry, restrictions, identity of the issuer and whether acceptance settles a cash repayment claim. The legal availability of repayment and the commercial attractiveness of a replacement should be considered separately.
6. Check the conditions behind a price increase
Article 9 limits the circumstances and method of increasing the price. It requires an express contractual basis, a qualifying reason, an explanation of the calculation communicated at least 20 days before departure, and a change not exceeding five per cent of the contract price. The permitted reasons relate to specified unusual exchange-rate or fuel changes and changes in relevant legal charges.
Do not reduce the analysis to whether the percentage is below five. A smaller increase still needs the other conditions. Ask which price component changed, which dates and rates were used, and why the adjustment applies to this booking. A general announcement that tourism costs have increased does not provide that calculation.
Distinguish a lawful price adjustment from a new optional excursion or an amendment the participant actively requests. The latter requires its own agreement. Keep an amended invoice alongside the original, with an explanation of each difference. This avoids confusing a disputed compulsory surcharge with a service the traveller separately chose to buy.
7. Report performance problems while they can still be addressed
Article 12 requires the participant to report shortcomings promptly to the relevant service provider, organiser or intermediary. Where they are not remedied, a price reduction becomes relevant. Important failures after the tour starts engage the further rules on equivalent arrangements without additional cost, withdrawal and return transport. An appropriate charge for services already enjoyed remains a separate consideration under the regulation.
Make the complaint specific: identify the promised room or service, what was provided, when the problem arose and the remedy requested. Preserve photographs of relevant conditions and the response, but avoid photographing unrelated guests or distributing private information. A written record that an alternative was offered and why it did not resolve the problem is more useful than a general assertion that nobody helped.
Package responsibility and an airline’s separate passenger obligations should not be conflated. For a flight disruption within the itinerary, see the English flight-delay guide. A baggage problem has different documents and notice rules, addressed in the lost and delayed baggage guide. Record compensation already received so the same loss is not claimed twice.
8. Consider transferring the booking without concealing the change
Article 15 permits a participant who cannot continue with the package to transfer it to a person satisfying the applicable conditions, using written or durable-medium notice at least seven days before departure. The transferor and transferee have joint responsibility for the outstanding price and legitimate additional transfer costs; those costs must be reasonable and cannot exceed the actual costs incurred.
Check the replacement traveller’s eligibility before proposing the transfer. Passport validity, visa requirements, age restrictions or an accepted special arrangement can affect whether that person satisfies the package conditions. A name change in a messaging group is not the same as properly completing the contractual transfer and any associated transport documentation.
Ask for an itemised transfer quotation and an updated participant confirmation. Clarify who pays the remaining balance and how a payment already made by the original traveller will be treated between them. Their private reimbursement arrangement should not obscure what the organiser has actually accepted. Keep both the original and updated booking records.
9. Write a notice that identifies the right being exercised
A useful notice contains the booking reference, participants, contractual departure date, payment details and an unambiguous statement of the action taken. Explain whether it is an ordinary termination, an exceptional late cancellation supported by evidence, or a response to the organiser’s change. Include a repayment request and ask for an itemised basis for any proposed deduction.
Send it through a channel that allows the content and receipt to be established. Retain the complete message, attachments, timestamp and acknowledgment. A screenshot showing only a sent icon does not explain what document was attached. Where a portal limits the length of a complaint, preserve the complete submission and any separately delivered supporting letter.
Do not include unnecessary medical histories, passport scans or family information in a publicly visible review. Supply sensitive supporting material only through an appropriate private channel and only to the extent relevant to the claim. A lawyer’s initial document review can identify what is needed without publishing the traveller’s private circumstances on the internet.
10. Calculate repayment, deductions and additional loss separately
Prepare a payment ledger showing the price, instalments, currency, payer, recipient and refunds already received. Allocate a voucher separately from cleared cash unless the settlement actually treats them as equivalent. Card-payment records and the tour invoice should be reconciled; currency conversion or an instalment facility can otherwise make the figures appear inconsistent.
Articles 13 and 14 distinguish responsibility for loss from the statutory grounds excluding damages liability. Compensation for wasted holiday time is not a fixed automatic sum added to every repayment. Identify the breach, causation and claimed loss, and assess any defence separately. An exceptional event affecting compensation does not, by itself, answer every question about repayment or assistance.
For a qualifying consumer claim filed in 2026, the Ministry of Trade’s official guidance places disputes below TRY 186,000 within the consumer arbitration committee route. The threshold and legal classification must be checked for the filing year. Court proceedings, applicable mediation and any exception require their own assessment; filing a general administrative complaint is not a substitute for the correct monetary remedy.
11. International bookings require a real jurisdiction review
A holiday taking place in Turkey is not sufficient, by itself, to determine every applicable law or defendant. Identify where the organiser and intermediary are established, how the package was marketed and sold, and which participant contracted. Article 2 expressly addresses packages from foreign organisers sold through an intermediary or representative in Turkey. Article 17 addresses the intermediary’s responsibility where the organiser lacks a Turkish representative.
A foreign resident should keep a reliable correspondence address and copies of identification matching the booking. The Ministry’s committee guidance accepts passport or foreign-identity details for other-country nationals. Online access requirements and representation documents should be checked before promising that the entire process can be completed through a particular portal.
Our physical offices are in Istanbul (Maslak/Sarıyer, Polaris Plaza) and Mersin (Akdeniz, Profit İş Merkezi). Reviewing a booking connected with another Turkish city does not create an office there or change the competent forum. English instructions, necessary Turkish documents and any local procedural step are organised within the agreed mandate. Sending an enquiry does not preserve a deadline or establish representation automatically.
12. Worked example: one booking, different legal outcomes
Assume a hypothetical family has paid TRY 80,000 for a qualifying package. If its cancellation notice is received 40 days before departure, the analysis starts with Article 16(2), not an unexplained late-cancellation percentage. Any compulsory legal-charge deduction must be identified. These figures illustrate method, not an actual client outcome or a quotation for legal services.
Change the facts: notice arrives ten days before departure because an unexpected event prevents participation despite appropriate care. The review now asks whether Article 16(4) is established and which third-party payments are genuinely documented and non-refundable. Simply moving the notice date does not prove that the exception applies.
Change the facts again: the organiser cancels the original package and offers another date that the family rejects. The issue is no longer merely the traveller voluntarily cancelling the original booking. Preserve the organiser’s notice and evaluate the choices under Articles 10–11. The same paid amount therefore supports different analyses depending on the event, evidence and remedy selected.
Frequently asked questions
Does an online booking always have a separate 14-day cooling-off right?
Do not assume that rule for a package tour. Classify the transaction and apply its own cancellation framework rather than importing the general online-goods rules.
Can the agent retain any percentage it chooses?
No. The legal category, contract and permissible deductions require examination. Ask for the clause and an itemised calculation.
Does a hotel-only booking qualify automatically?
No. A package requires the relevant combination and duration or overnight element; a standalone hotel reservation needs separate review.
Must I accept a voucher instead of money?
Review the applicable repayment right before accepting. A proposed voucher is not automatically equivalent to the required cash repayment.
Can I cancel late because of an unexpected event?
Article 16(4) has specific conditions and permitted deductions. The event, inability to participate and supporting evidence must be established.
Can another person take my place?
Article 15 addresses eligible replacement travellers, notice timing and actual additional costs. Confirm the transfer properly.
Does an airline payment settle the whole package dispute?
Not necessarily. Identify what it compensates and avoid duplicate recovery of the same loss.
Can a foreign traveller obtain a review from abroad?
Yes. Provide the complete booking, payment and notice records. Representation, jurisdiction and original-document requirements are assessed separately.
