Turkey Family Residence Permit: Sponsor Income, Spouse, Children and Articles 34–37
A family residence permit in Türkiye is governed by Articles 34–37 of Law No. 6458 and is available to qualifying foreign spouses, minor children and dependent foreign children of specified sponsors. The sponsor must generally satisfy income, insurance, accommodation, criminal-record, residence-history and address-registration conditions. The permit is not issued merely because the parties are married: the foreign spouse must genuinely live or intend to live with the sponsor, be at least 18, satisfy entry conditions and not have entered the marriage solely to obtain residence.
Family residence permit: sponsor checklist
| Sponsor condition | Current statutory rule | Important exception/detail |
|---|---|---|
| Income | Total monthly income at least the minimum wage and at least 1/3 minimum wage per family member | Both the total floor and per-person calculation matter. |
| Health insurance | Valid coverage for all family members | Coverage must match the requested period/legal requirements. |
| Accommodation | Suitable for family size and health/safety standards | Nominal address registration is not enough. |
| Criminal record | No conviction for crimes against family during previous 5 years | Must be evidenced by criminal-record documentation. |
| Residence history | Generally at least 1 year residence in Türkiye | Statutory exceptions include spouses of Turkish citizens and specified scientific/Blue Card situations. |
| Address registration | Sponsor must be registered in address-based system | The residence address should reflect actual family life. |
1. Article 34 defines which family members can use the family-residence route
Family residence can be issued to the foreign spouse, foreign minor children of the sponsor or sponsor’s spouse, and dependent foreign children of the sponsor or spouse. Eligible sponsors include Turkish citizens, persons within Article 28 of Turkish Citizenship Law No. 5901, foreigners holding qualifying residence permits, and refugees or subsidiary-protection beneficiaries within the statutory system.
The family link must be proved with legally usable marriage, birth, custody or dependency documents. A person described socially as a partner, parent or child does not automatically fall within the statutory category without the legal relationship required by Article 34.
Other relatives—such as siblings, parents or cousins—do not obtain family residence simply because the sponsor agrees to support them. They need another lawful residence basis unless a separate rule applies.
2. The sponsor is legally responsible for proving the statutory support conditions
The sponsor is not merely the person whose name appears on the application. Article 35 imposes specific conditions concerning income, housing, insurance, criminal history, residence history and address registration.
When both spouses are foreigners and wish to use family residence, Migration Management explains that one foreigner must first occupy the role of sponsor; family residence cannot simply be issued simultaneously to both as if each sponsors the other at the same moment.
The supporting documents should be current and consistent with the declared household. The sponsor’s address, employment/income and family-member count directly affect the assessment.
3. The sponsor income rule has two parts
Article 35 requires monthly income that is not less than the minimum wage in total and corresponds to at least one third of the minimum wage per family member. This means the calculation has both a total household floor and a per-person component.
For example, where the family consists of sponsor, spouse and one child, the per-person calculation is applied across the family, while the overall sponsor income must still satisfy the minimum-wage floor. Because the minimum wage changes, a legal guide should not hard-code an old lira figure as if it remains permanent.
Salary, business income, pension, rental income or other lawful recurring resources can be relevant. If the administration requests proof, the income should be traceable through payroll, tax, banking or other official documentation.
4. Insurance and accommodation must cover the actual family situation
The sponsor must provide health insurance covering all family members and live in accommodation suitable for the number of people and general health/safety standards. The application should therefore reflect where the family genuinely resides.
If the family lives with a third person, the current accommodation-document rules may require notarised undertakings depending on the arrangement. The address should also be consistent with the address-registration system.
Insurance must be valid for the relevant people and period. A policy covering only the sponsor does not satisfy a statutory requirement for family-wide coverage.
5. The one-year sponsor residence rule has important statutory exceptions
Article 35 generally requires the sponsor to have lived in Türkiye for at least one year on a residence permit. However, that condition does not apply in the same way to specified categories, including foreigners married to Turkish citizens, persons within Article 28 of Law No. 5901 and qualifying scientific-research permit/work-permit holders.
A foreign spouse of a Turkish citizen should therefore not be told to wait one year solely because a generic checklist copied the ordinary sponsor condition. The statutory exception must be applied.
For two foreign spouses, by contrast, the sponsor’s residence history can be central. Work-permit residence equivalence should be reviewed where relevant.
6. The foreign spouse must show a genuine family-residence purpose
The spouse must provide the information and documents showing the Article 34 family relationship, state that the spouses live or intend to live together, be over 18, not fall within Article 7 entry restrictions, and not have entered the marriage for the purpose of obtaining family residence.
Marriage to a Turkish citizen does not automatically produce Turkish citizenship or a family residence card. These are separate legal statuses. Our citizenship by marriage guide explains the distinct three-year Article 16 nationality route.
Where the marriage certificate was issued abroad, authentication and Turkish registration issues should be resolved so the immigration authority can verify the relationship.
7. Children can qualify, but custody and consent rules matter
Foreign minor children and dependent adult children within Article 34 can qualify. For a child whose other parent lives abroad and shares custody, Migration Management requires the consent of that parent for the child’s family residence.
Divorce judgments, custody orders, birth certificates and parental-consent documents issued abroad may require apostille/legalisation and Turkish translation. The legal custody arrangement should be clear.
A child does not lose all immigration options merely because family residence conditions are absent; another permit type can be considered if its statutory conditions are met.
8. Family residence is time-limited and linked to the sponsor’s status
Current Turkish Migration Management guidance states that family residence can be issued for up to three years at a time and cannot exceed the duration of the sponsor’s residence permit.
Some older English FAQ material still refers to a two-year maximum. Where official language versions conflict, the current Turkish guidance and current statutory text should be checked at the filing date. This article uses the current Turkish published three-year rule.
If the sponsor’s status ends earlier, the family member should not assume the printed card necessarily remains insulated from the sponsor’s changed legal position.
9. Children holding family residence can attend primary/secondary education without a student permit
Family residence gives qualifying children the right to attend primary and secondary education until age 18 without obtaining a separate student residence permit. This removes unnecessary duplicate immigration status during childhood.
After age 18, a student who continues education should move to the residence category that matches the new legal situation where family residence no longer applies.
Our Turkey Student Residence Permit guide explains higher-education and post-18 rules.
10. The administration can investigate whether the marriage was entered solely for residence
Law No. 6458 prohibits family residence where the marriage was entered into solely to obtain the permit. The implementing regulation identifies indicators that can create reasonable suspicion and trigger investigation, including lack of a shared home/family unity, absence of a common language, an unreasonable age difference and other relevant facts.
These indicators are not automatic proof of a sham marriage. They trigger factual investigation. Genuine couples can have age differences, periods of separate residence or language barriers that have real explanations.
Applicants should answer truthfully and document the actual family relationship. Manufactured leases, staged photographs or rehearsed false statements can create serious legal consequences.
11. Family residence can be refused, cancelled or not renewed
The permit is refused, cancelled or not renewed where the statutory family-residence conditions are absent or cease to exist, the permit is used outside its purpose, or a current removal decision or entry ban exists. The implementing regulation also addresses absence abroad and sham-marriage findings in the family-residence context.
The adverse decision must be examined as a specific administrative act. A refusal based on sponsor income is different from one based on sham-marriage findings or an entry ban.
The evidence and court challenge should respond to the stated legal ground rather than submit the same documents regardless of reason.
12. Divorce can end the family-residence basis, but Turkish law provides transition routes
A foreign spouse of a Turkish citizen who has lived in Türkiye for at least three years on family residence can apply for short-term residence after divorce under the statutory conditions. Where the foreign spouse proves through a relevant court decision that he or she was a victim of domestic violence, the three-year condition is not required.
Our existing Family Residence Permit After Divorce guide covers that transition in depth, so this article does not duplicate the post-divorce procedure.
The divorce date and residence history should be documented precisely. A pending divorce and a final divorce judgment can have different effects on the family-residence basis.
13. Death of the sponsor can permit transition without a minimum residence period
Where the sponsor dies, persons who were residing on family residence connected to that sponsor can move to short-term residence without the ordinary minimum family-residence period in the statutory circumstances.
The death certificate and family relationship should be legally recorded. Foreign death records may require authentication and translation.
The new permit is still a separate immigration status; the authority does not simply leave the old sponsor-linked card unchanged indefinitely.
14. Family residence does not generally replace a work permit
Holding family residence allows legal residence but does not, by itself, remove the work-permit requirement. A foreign spouse intending to work should assess Law No. 6735.
Current work-permit criteria provide exemptions from some general evaluation tests for certain foreigners who have lived in marital unity with a Turkish citizen for at least three years, but that is not the same as exemption from all work authorisation.
Our work permit guide explains the current employer and exemption rules.
15. A refusal can be challenged under administrative law
A family-residence refusal, cancellation or non-renewal should be obtained in writing with its notification record. The general administrative-court remedy must be calculated from the actual decision unless a special period applies.
Our residence permit rejection appeal guide explains the general sixty-day framework and the distinction from deportation litigation.

Conclusion: the sponsor and family relationship are both tested
A Turkey family residence permit is not based on marriage or kinship alone. Articles 34–37 require a qualifying family relationship and a sponsor who satisfies income, insurance, accommodation, criminal-record, residence-history and address conditions, subject to statutory exceptions. The foreign spouse or child must also meet the relevant conditions. A strong application proves both sides of the relationship and keeps the immigration record consistent as family circumstances change.
