Signing a Turkish Estate Partition Agreement from Abroad

Short answer: Civil Code Article 676 requires an estate partition agreement to be in writing. Heirs living abroad must also establish who is entitled to participate, what assets and obligations are being divided, who has authority to sign and what further registration or payment steps are required. A signed division agreement is different from a transfer of an inheritance share to an outsider, which Article 677 subjects to a separate notarial form. Allocating a debt between heirs does not automatically release them against the creditor. The document must be designed for the actual estate and the transactions needed to implement it.

Legal issueSigning a Turkish Estate Partition Agreement from Abroad
Short answerCivil Code Article 676 requires an estate partition agreement to be in writing.
Key legislationLaw No. 4721 — Articles 640, 646, 676, 677, 678, 679, 680, 681, 682; Law No. 6098 — Articles 14, 15, 504; Law No. 5718 — Articles 7, 20, 21(4)

Start with the correct heirship record

A consensual partition begins with the persons entitled to the estate. Obtain the relevant inheritance certificate, death record and testamentary documents, and identify any challenge affecting heirship or shares. A document signed by the relatives who happen to be available should not be presented as a completed agreement binding an omitted heir. Foreign residence does not reduce an heir’s entitlement to participate.

Check for successive deaths. If an original heir survived the deceased but later died, that person’s interest must be traced through their own succession. The family tree and signing arrangements should reflect the resulting chain. Similarly, identify any protected person whose participation requires lawful representation and the relevant permissions. A general family consensus does not replace those legal safeguards.

Civil Code Article 640 describes the community of heirs and their joint power over estate rights, subject to lawful representation and management. The community-of-heirs guide explains that starting position. The agreement must work with the actual community rather than assume that one heir owns and can distribute the assets on behalf of everyone.

State exactly what the agreement divides

Article 676 allows the heirs’ partition agreement to deal with the estate’s assets and also permits agreement to convert undivided community ownership over all or part of the estate into co-ownership in proportion to inheritance shares. These outcomes are different. Allocating an apartment entirely to one heir is not the same as converting the ownership into defined fractional shares among all heirs.

Describe the intended result for each asset. Use official property identifiers for land, the relevant account or claim information for money and the appropriate ownership details for company interests. Separate the deceased’s property from assets belonging to a spouse, company or another family member. An estate agreement cannot accurately divide an asset that has never been established as part of the estate.

State whether the agreement is comprehensive or limited to identified assets. Identify any matters left unresolved, including pending claims, disputed debts and later-discovered assets. The purpose is to avoid a document that appears to settle the entire inheritance while its schedules cover only one property. The scope must be understandable to the heirs and to the institutions asked to implement it.

Article 676 establishes written form, but signatures still require legal analysis

Article 676 expressly makes the validity of a partition agreement dependent on written form. The provision should be read as the legal baseline for that agreement, rather than replaced with an unsupported statement that every partition contract must be drawn up by a notary. At the same time, other transactions included in the document and later implementation steps can have their own formal requirements.

Code of Obligations Articles 14 and 15 regulate written form and signatures. They address the signatures of persons undertaking obligations and the legal effect of a secure electronic signature, together with specified methods that can satisfy writing in the circumstances stated by the provisions. A pasted image of a signature or an ordinary typed name should not be assumed to meet every statutory requirement.

For remote execution, choose a method whose legal sufficiency can be established for the actual document. Preserve the complete signed version, annexes and any evidence needed to authenticate the signatures. Ensure that everyone signs the same terms. A final page signed in one country and attached later to a changed schedule creates an evidential problem even where the parties originally intended to cooperate.

Authority to obtain a certificate is not automatically authority to divide property

An heir abroad can act through a properly authorised representative, but the mandate must match the acts required. Code of Obligations Article 504 addresses the scope of agency and expressly requires special authority for listed acts, including settlement and transfer or encumbrance of immovable property. Review the actual powers rather than relying on a document’s general heading as a “power of attorney.”

Identify whether the representative will negotiate, sign the partition agreement, settle a disputed entitlement, receive money, transfer title or complete a bank transaction. These actions can require distinct language and institutional requirements. A mandate prepared for one inheritance-certificate application should not be assumed to cover every later disposition. Obtain the relevant advice before the heir signs abroad, so an inadequate instrument does not have to be replaced after the other parties are ready.

Where one person represents several heirs, examine conflicts and the authority for the proposed arrangement carefully. The representative’s convenience does not determine each heir’s entitlement. Instructions should specify the agreed allocation and any limits on payment or settlement. Keep evidence of those instructions with the executed documents so the implementation can be checked against the authority actually given.

Use schedules that make the allocation executable

For each asset, state the recipient, the interest allocated, the agreed value or valuation mechanism, delivery or registration steps and responsibility for the specified transaction costs. If equalisation payments are part of the settlement, record the payer, recipient, amount, currency, due date and the conditions linked to completion. The agreement should not rely on an undefined statement that the family will “balance matters later.”

Disclose relevant burdens and practical constraints. A mortgage, tenancy, possession dispute or pending claim affects what the recipient actually receives. A title schedule that identifies the property but ignores its legal burdens can conceal a substantial difference between the apparent and actual allocation. Obtain current information rather than copying an old title document without checking subsequent changes.

Article 646 requires heirs holding estate property or owing money to the deceased to provide complete information in the partition. This matters to balances between heirs, rental receipts and other estate dealings. Set out the records used to reconcile those items and distinguish agreed figures from disputed allegations. The general partition guide concerns the broader division framework; the agreement needs the additional precision required for voluntary implementation.

An internal promise to pay does not automatically discharge the others against creditors

Civil Code Article 681 preserves joint and several responsibility after partition for estate debts whose division or transfer the creditor has not expressly or implicitly accepted. The heirs must therefore distinguish their agreement among themselves from its effect on an outside creditor. A clause stating that one heir will pay a loan is not, by itself, proof that the lender has released every other heir.

Identify each debt, the creditor’s position and any consent or release needed for the intended outcome. Obtain the relevant confirmation in a legally effective form instead of assuming that silence after receiving the agreement constitutes acceptance in every circumstance. The statute recognises express or implied consent, but whether the actual conduct establishes it requires legal assessment.

Article 682 supplies recourse rules where an heir pays an estate debt not allocated to them or pays more than their allocated amount. It first directs recourse against the heir who undertook the debt in the partition agreement; otherwise, absent a contrary agreement, heirs bear the debts according to their inheritance shares. Drafting a clear allocation therefore matters internally even where creditor-facing responsibility remains. Preserve payment records so any later recourse can be established.

Do not confuse partition with selling an inheritance share

Article 677 separately governs transfer of an inheritance share over all or part of the estate. A transfer between heirs is subject to written form. A corresponding agreement with a third person must be drawn up by a notary. The provision also states that the third-person agreement does not confer a right to participate in partition; it gives the right to demand delivery of the share allocated to the transferring heir after partition.

That distinction matters where the intended transaction includes an outside purchaser. Calling the document a “family partition agreement” cannot remove the form and legal consequences of a transaction that is actually an assignment to an outsider. Identify the substance of each clause and the persons affected. A document can contain more than one legal transaction, each requiring its own assessment.

Article 678 addresses agreements about an inheritance not yet opened. Without the deceased-to-be’s participation or permission, the stated agreements between an heir and other heirs or a third person are invalid, and performance can be reclaimed. A post-death partition and an arrangement made while the estate owner is alive should therefore not be treated as interchangeable. Establish when the contract was made and the legal situation at that time.

Consider invalidity and responsibility after partition

Article 680 applies the Code of Obligations’ general invalidity rules to partition agreements. Written form alone does not resolve every issue affecting validity. Capacity, representation and the legally relevant circumstances of consent must be reviewed. A signature obtained on terms the signer did not understand cannot be treated as an invitation to ignore the law governing the actual consent question.

Where heirs use different languages, ensure that the terms and their legal effect are explained accurately before execution. Decide which text is authoritative and how any other language version is linked to it. Do not insert inconsistent asset schedules or payment terms in different versions. The legal review should compare the entire documents, including annexes, rather than only their headings.

Article 679 also creates post-partition responsibility between heirs in relation to the property allocated, with specific rules for assigned claims and a limitation provision. The agreement should therefore record the representations, disclosed defects and underlying claims accurately. The guide to liability after partition addresses that separate stage. Completion of the division is not a universal release from every statutory responsibility.

Signing, registration, delivery and payment are different completion events

Dates after completion also need to be recorded. Article 681 states that joint and several responsibility ends five years after partition, or, for obligations due later, five years after their due date. This is a rule about that joint and several responsibility; it should not be rewritten as a statement that every estate debt disappears five years after the agreement is signed. Record the legally relevant completion and maturity dates, and examine the underlying debt and any other applicable rules separately.

Article 679 has a different time rule for the warranty and surety claims it regulates between heirs: one year from partition, or from maturity for claims to be performed later. The agreement file should therefore retain the evidence establishing when the relevant allocation was completed and when the assigned claim became due. A diary entry based only on the day the first heir signed abroad can overlook the event used by the statutory rule.

These provisions reinforce the need for a closing record agreed or otherwise reliably evidenced. Identify outstanding registration, delivery, payment and document obligations instead of describing the entire transaction as complete while material acts remain pending. Preserve the correspondence explaining any delay and the final evidence of performance. This allows a later adviser or court to assess the particular statutory period using the actual transaction record, rather than reconstructing completion from scattered signature pages.

A signed agreement must be translated into the legally required acts for each asset. For real property, check the land-registry steps, identities, representation and supporting documents. For bank funds, establish the institution’s lawful release requirements. For company interests, coordinate the relevant corporate and registration formalities. The agreement should identify who is responsible for obtaining and submitting each document.

Use a completion record. Note when the agreement was executed, each payment made, an asset delivered or a registration completed. Check the result against the agreed allocation and correct discrepancies through the proper process. A transfer instruction is not proof that the bank paid, and a registry appointment is not proof that ownership was registered.

Keep tax and transaction-cost obligations distinct from the inheritance allocation. A family agreement can allocate specified economic responsibilities between the parties, but it does not rewrite public-law obligations or grant a tax exemption. The relevant tax and administrative rules must be separately checked for the actual transaction. Avoid statements in the agreement that purport to bind an authority that is not a party to it.

Coordinate foreign execution with the Turkish legal framework

Law No. 5718 Article 20 addresses succession and provides that rules concerning the opening, acquisition and partition of the estate follow the law of its location. It also expressly applies Turkish law to immovables in Turkey. The form and effect of an agreement executed abroad must therefore be assessed in the correct international framework rather than assumed from the overseas signing location alone.

The form analysis also requires Articles 7 and 21(4). Article 7 generally permits a transaction to follow either the form prescribed by the law of the country where it is made or the substantive law governing the transaction. Article 21(4) specifically subjects the form of transactions concerning real rights in immovables to the law of the property’s location. Identify the precise act being signed: a partition arrangement, a separate disposition of an immovable right and a representative’s authority are not interchangeable. The overseas signing location alone does not establish that every included property transaction satisfies its applicable form.

Authentication and translation arrangements should be established for each foreign document’s intended use. The original power of attorney, signed agreement, identity evidence and court documents can perform different functions. Confirm the requirements before circulating signature pages. Keep all versions under control so a revised allocation does not leave different heirs signing different texts.

Frequently asked questions

Must a partition agreement be written?

Yes. Civil Code Article 676 makes written form a validity requirement for the agreement.

Does Article 676 require every partition agreement to be notarised?

The article’s baseline is written form. Other included transactions and implementation steps must be checked separately for their own formal requirements.

Can an heir abroad sign through a representative?

Yes, with legally sufficient authority for the actual acts. Article 504 requires special authority for specified transactions, including settlement and immovable dispositions.

Is an ordinary scanned signature always sufficient?

That should not be assumed. The chosen execution method must satisfy the applicable written-form and signature rules for the actual transaction.

Can the agreement divide only some estate assets?

Article 676 permits arrangements concerning all or part of the estate. The document must clearly state its scope and what remains unresolved.

Does allocating a loan to one heir release the others against the bank?

Not automatically. Article 681 preserves creditor-facing responsibility where the creditor has not accepted the division or transfer of the debt.

How is a transfer to an outsider different?

Article 677 requires the corresponding inheritance-share agreement with a third person to be drawn up by a notary and does not itself give that person partition participation rights.

Can relatives bind an omitted heir by agreeing among themselves?

An omitted heir’s rights cannot be treated as settled simply because others signed. Establish all participants and lawful representation.

Does signing automatically complete title registration?

No. The agreement and the asset-specific registration or delivery steps are distinct events that must be completed and verified.

What should the final file contain?

The complete executed agreement, authority documents, asset schedules, creditor arrangements and proof of each registration, delivery and payment.

The official Turkish legislation controls. The applicable rules and procedural steps must be assessed against the facts of the individual estate.
