An İsticvap Summons from a Turkish Court While You Live Abroad: Personal Answers and Admissions

Short answer: An isticvap summons requires a party’s own answers to specified facts in a Turkish civil case. Under Code of Civil Procedure Articles 169–175, a lawyer’s attendance does not substitute for that examination. Article 171 attaches a deemed-admission consequence to unjustified failure to attend or answer after the required summons and warning. A person abroad should promptly seek the court’s determination of the lawful hearing arrangement under Article 172, address any genuine obstacle and arrange interpretation where needed.

İsticvap concerns the party’s answers about facts underlying the case

Code of Civil Procedure Article 169 permits the court, on its own initiative or on request, to order the examination of either party. The examination concerns facts forming the basis of the case and related matters. It is a specific civil procedural act. A party should not treat the summons as an optional invitation to meet the opposing lawyer or as a routine hearing that can necessarily be handled entirely by representatives.

The court is seeking the designated person’s own answers. That is different from counsel’s legal submissions, an expert’s opinion or the testimony of a third-party witness. The relevant procedural status should be identified before preparing a response. A document from a criminal authority requiring questioning follows a different legal framework; the presence of the English word interview in a translation does not make it an HMK isticvap examination.

The subject of the order should be linked to the disputed facts in the pleadings. Obtain the application or court direction that led to the summons, together with the relevant hearing record. Understanding the factual issue helps the party identify the original documents needed to refresh memory. It also helps counsel raise a focused procedural concern if the notice does not adequately identify the examination’s subject, rather than advising the party simply to ignore it.

Article 171 requires a personal summons identifying the facts and consequence

Article 171 provides for a summons sent personally to the person whose examination has been ordered. It must identify the day and time when that person is required to be ready for questioning. It must also show the facts that are the subject of the examination and warn of the consequence of failure to attend without a valid excuse, or attendance followed by failure to answer. These are substantive features of the statutory summons.

Read every page, including the warning and any attached list of facts. A hearing date copied into an email by a relative may omit the very terms that determine the order’s significance. Preserve the service documentation and the original language alongside any translation. The requirement for personal examination and the formal method of international service are separate issues that both need to be checked in the actual file.

If the summons appears incomplete, counsel should identify the precise defect and seek the appropriate procedural response. The party should not unilaterally declare the notice invalid and fail to attend. Equally, the court’s warning should not be expanded into an assertion that absence necessarily admits every allegation made anywhere in the lawsuit. The statute connects the consequence to the facts submitted for examination through its prescribed process.

Unjustified absence or unanswered questions can amount to an admission

Article 171 states that the summoned party who fails to attend without excuse, or attends but leaves the questions unanswered, is treated as admitting the facts asked by the court. This is a serious evidential consequence. It differs from merely losing an opportunity to make an argument. A party abroad should therefore prioritise the summons even if counsel already attends ordinary hearings and the wider case has proceeded remotely for months.

The statutory conditions must be assessed together: the correct person, the required invitation and warning, the examination’s subject, the absence or failure to answer and any valid excuse. The article does not create a rule that foreign residence alone excuses non-attendance. Nor should an admission consequence be described as an automatic final judgment for the opponent without regard to the remaining legal requirements of the case.

A genuine inability to answer a question accurately should be explained truthfully rather than disguised by a fabricated answer. The distinction between lacking personal knowledge, needing clarification and deliberately refusing to answer requires careful handling in the hearing. Counsel can address the procedural position, but cannot manufacture the party’s recollection. The sound preparation is to understand the facts and records, identify uncertainty honestly and request clarification when the question is unclear.

The person examined for a legal entity must have representative authority

Article 170 provides that persons with authority to represent a legal entity are examined on its behalf. A foreign company should therefore check its current representation records and the person identified by the court. An employee who knows the commercial history, an external accountant and the lawyer conducting the case do not become the company’s proper examination representative merely because they can explain the transaction.

Supply the relevant corporate registry documents, appointments and signature rules. If authority changed after the transaction or more than one signatory is required, disclose that accurately and ask the court to resolve the proper attendance arrangement. The person ordered to answer should understand the basis of their authority and the records available. Corporate preparation must preserve the distinction between knowledge derived from company records and events personally witnessed.

Article 170 also addresses transactions carried out on behalf of a minor or a person under a restriction, directing examination to the legal representative, with an exception where the law gives the individual a personal right to bring the case. This prevents a blanket assumption that every protected person must always be replaced by a representative. The capacity, transaction and particular litigation right must be identified before deciding who is required to answer.

Article 172 provides alternatives, but does not authorise a self-arranged video call

Article 172 starts from the requirement that the person attend personally. It then addresses someone living outside the province where the court is located: if examination by simultaneous sound and image transmission from that location is not possible, examination is conducted by judicial assistance. The statutory structure distinguishes personal participation from the physical place where an authorised examination takes place. It does not permit counsel to give the answers instead.

For a person in another country, the court-approved method must also be lawful in that country and use the applicable international-assistance arrangements. Do not assume that a laptop, a private video link or an available consular appointment settles that question. Identify the country, current address, identity documents and practical availability early enough for the court to decide the route. The general guide to taking evidence abroad for Turkish civil cases explains why the international channel requires a separate country-specific check.

Article 149 regulates participation by simultaneous sound and image transmission under the court’s authority. Permission for a lawyer to attend an e-hearing does not itself establish permission for the party’s isticvap from an overseas home. The order must cover the particular person and procedural act. This explanation uses the law effective on 28 October 2026; the amendment made by Law No. 7589 Article 22, identified in the official consolidation as effective on 31 October 2026, is not applied prematurely.

A genuine physical obstacle should be documented and submitted to the court

Article 172’s second paragraph provides for examination at the person’s location where illness, disability or a comparable reason prevents personal attendance at court. The relevant issue is the actual inability to attend and the examination arrangement it requires. A medical appointment confirmation and a record demonstrating inability to travel can prove different facts. Supply evidence describing the real functional obstacle and its dates without exaggeration.

Raise the issue promptly through counsel and obtain the court’s response. An email sent to the opposing party explaining an illness does not itself amend the court’s order. Where the obstacle changes, update the information rather than continuing to rely on an outdated certificate. The request should propose the legally appropriate adjustment and identify any necessary interpretation, accessibility or location arrangements.

If the hearing has already been missed, obtain its minutes before assuming that nothing happened. The court may have recorded absence, an excuse, a warning or a procedural consequence. The appropriate challenge depends on that record and the stage reached. A separate remedy for restoring a missed procedural opportunity is conditional and should not be advertised as an automatic cure for an ignored isticvap summons.

Interpretation and protected information require specific arrangements

Article 175 applies specified witness provisions to isticvap insofar as compatible with its nature. Those provisions include Article 263, under which a person who does not know Turkish is heard through an interpreter. An English-language consultation with counsel is not the court’s interpretation arrangement. Tell counsel which language the person can understand and speak sufficiently for precise factual questions, and request the required arrangement before the examination begins.

The incorporated provisions also include Articles 249 and 250 concerning legally protected secrets and specified risks to interests, reputation, criminal exposure or professional secrets. Their application requires attention to the nature of party examination. They are not an unrestricted right to remain silent about every inconvenient fact. A person concerned about a particular protected matter should identify it privately to counsel so that the legal ground can be presented to the court appropriately.

Do not disclose a protected document publicly merely to demonstrate why an objection may exist. Preserve the document and explain its provenance through the confidential preparation process. The court should receive a legally grounded request identifying the issue and proposed handling. A blanket refusal without analysis can create a different procedural problem from a properly raised statutory protection.

Prepare the chronology and originals without writing a script

Preparation should connect the facts named in the summons with contemporaneous records. Put contracts, messages, payments, delivery records and relevant corporate documents into a chronological index. Identify which events the person remembers directly and which are known only from documents or another person’s report. A chronology is useful for accurate recollection, but it must not be used to create certainty that the records do not support.

Article 173 prohibits using written notes during examination without the court’s permission. The party should therefore not assume that a prepared statement can simply be read aloud. Where dates, figures or records need to be consulted, raise that need with the judge. The incorporated witness provisions address permission to consult writings for the stated purposes; the actual examination remains under the court’s control.

A lawyer can explain the procedure, identify relevant documents and help the person understand the factual issues. That work must preserve truthful personal answers. Do not rehearse a false account, omit known contradictory records or alter messages to make a chronology appear consistent. Where documents reveal an error in an earlier recollection, discuss the correction candidly so that the court receives an accurate explanation rather than a polished but unreliable narrative.

The examination remains personal even when lawyers are present

Under Article 173, the judge reminds the examined party of the duty to tell the truth before questioning. The opposing party and the parties’ lawyers may be present. Their attendance does not convert the examination into a negotiation or allow counsel to answer on the party’s behalf. The person should listen to the actual question, ask for clarification through the accepted procedure and give the answer within their knowledge.

Article 175 incorporates the specified rules governing the conduct of questioning, including restrictions on interruptions and other prohibited behaviour. A representative should raise legal issues in the manner permitted by the court, rather than signalling an answer or interrupting the person repeatedly. An interpreter likewise serves accurate communication; interpretation is not an opportunity to improve or change the substance of an answer.

For an authorised remote examination, follow the court’s instructions about identity, location and connection. If sound or image fails, report it immediately and ensure that the problem is recorded. A question not heard clearly should not be answered by guessing. Preserve the genuine technical information needed to explain an interruption, while leaving the procedural response to the court rather than disconnecting and assuming the hearing will be rescheduled.

Article 174 requires a record of the explanations, questions and answers

At the end of the examination, Article 174 requires a record containing the party’s explanations, the questions and the answers. It is read in the parties’ presence and signed by the examined person. If that person refuses to sign without a justified reason, the judge records the refusal. The record is therefore an essential part of the evidence, not a formality that can safely be ignored once the questioning ends.

Listen to the reading and identify a material recording or interpretation problem promptly. A request to correct an inaccurate transcription should state precisely what was asked or said. It should not be used to replace an inconvenient truthful answer with a different account. Obtain the official record through counsel after the hearing and preserve any directions for further evidence or clarification.

Organise the overseas response around the court’s actual direction

Send counsel the full summons, service evidence, examination order, current address and any obstacle documents. Identify the language needed and whether a company representative is involved. Ask for confirmation of the authorised attendance method and any pending request. The broader guide to handling Turkish legal matters without repeated travel explains the difference between representation and personal participation. An isticvap order is precisely the kind of step for which that distinction must be resolved before the hearing.

Frequently asked questions

Can my lawyer answer an isticvap summons for me?

No. The ordered examination is personal. Counsel can represent you procedurally and be present, but cannot substitute their answers for yours.

What must the summons identify?

Article 171 requires the date and time, the facts to be examined and the warning about the consequence of unjustified absence or failure to answer.

What happens if I do not attend without a valid excuse?

Under Article 171’s conditions, the facts asked by the court are treated as admitted. This is an evidential consequence requiring serious attention.

Does living abroad automatically excuse attendance?

No. The court must address the lawful examination arrangement. Article 172 provides specified alternatives, and the international route requires a country-specific check.

A private link is not court permission. The actual person, location and procedural act must be covered by the authorised arrangement.

Who answers for a company?

Article 170 identifies persons with representative authority. Corporate records and the court’s direction should establish the proper individual.

Can I read prepared notes?

Article 173 requires the court’s permission to use written notes. Explain any need to consult dates or figures rather than assuming unrestricted use.

What if I do not speak Turkish?

Article 175 incorporates the applicable interpretation provision in Article 263. Arrange the required interpreter through the proceeding before examination.

Can protected information justify refusing a question?

The incorporated Articles 249 and 250 require specific legal analysis compatible with isticvap. They do not provide a blanket right to avoid all difficult questions.

Should I check the examination record?

Yes. Article 174 requires the explanations, questions and answers to be recorded, read and signed, with unjustified refusal to sign recorded by the judge.
