Establish whether there is a formal refusal decision
A delayed appointment, a request for another document and a formal refusal are different stages of a Turkish land-register application. Article 26 of the Land Registry Regulation (Tapu Sicili Tüzüğü) addresses refusal of a request that does not comply with the legislation and cannot receive a provisional registration annotation under Civil Code Article 1011. The first task is to obtain the actual decision and its notification record.
Article 22 requires deficiencies or mistakes identified in the request documentation to be addressed before the signature stage. A clerk’s explanation that a document is missing may therefore describe an incomplete transaction rather than a served Article 26 decision. Record what was requested, what was submitted and what the office communicated. Do not invent a refusal date from an informal conversation.
A formal decision should be read in full. Identify the office, property, application, journal reference, operative result and stated reasons. An English summary supplied by an intermediary is useful for understanding but does not replace the official text. The response should answer the particular legal obstacle recorded by the registry rather than repeat a general demand to transfer title.
Identify the request and the person entitled to make it
Article 16 generally requires a written request for a registry transaction and provides for an application-request document. Article 17 identifies who can request action: ordinarily the registered right holder, with statutory exceptions and a route for those who acquired a right before registration upon production of the necessary documents. The legal capacity in which the applicant acts must therefore be clear.
Distinguish the owner, intended buyer, heir, mortgage creditor and representative. Each may be seeking a different entry on a different documentary basis. A buyer’s payment does not by itself establish authority to request every alteration to the seller’s title. The application should state the exact transaction and identify the legal act or event supporting it.
Article 16 also requires a Turkish identification number or the property’s block and parcel information for the specified register enquiries, including attachment-related enquiries. Accurate property identification is essential throughout the file. Confirm the current cadastral reference and independent unit rather than rely only on a street address, marketing name or an old photocopy of the title.
Article 1015 requires both authority and a legally sufficient cause
Civil Code Article 1015 makes registration, cancellation and amendment dependent on documentation of the applicant’s power of disposition and the legal cause. Authority is established by showing that the applicant is the registered right holder or that person’s representative. The legal cause must be documented in the form required for its validity. These are separate elements of the registry review.
A valid power of attorney does not cure an invalid underlying transaction. Likewise, a complete contract does not establish that the person presenting it is authorised to perform the requested act. Divide the refusal reasons accordingly. Identify whether the office questions identity, representation, entitlement, required form, the operative document or another legal restriction affecting the property.
Article 1016 states that an application is refused where the documents relating to disposition authority and legal cause are incomplete, subject to its specific provisional-annotation qualification. The response should therefore identify what is missing and whether it can lawfully be completed. A general assertion that the transaction is commercially fair does not supply a document or form required by the Code.
Foreign identity and representation documents need transaction-specific review
Article 18 requires the office to determine whether the request comes from the right holder and to compare identity information with the underlying records. For foreign natural persons and foreign-incorporated commercial companies, paragraph 8 authorises the General Directorate to determine the documents used in land-registry and cadastral transactions. A foreign application should be checked against the requirements applicable to that person and act.
Where a representative applies, Article 18 requires authority covering the requested work. It also addresses the principal’s signature and, where a substitute representative acts, production of the underlying power supporting substitution. Obtain the entire authority chain. A translated first page or a broad statement that the agent handles property is not a substitute for the operative powers and formal document.
For a legal entity, the office examines the entity’s capacity to perform the transaction and its representation documents. Identify the entity’s exact registered name and the person authorised to bind it. The site’s foreign-buyer title-transfer guide explains the wider transaction file. A refusal appeal should isolate the particular defect instead of resubmitting the same unexplained document package.
A court order, inheritance record and sale agreement are different bases
Article 20 identifies documents for specified transactions that do not require an official deed. These include inheritance-based requests, particular legacy and partition situations, compulsory-sale registrations, final court decisions and finalised planning implementation documents. The correct category matters. A document sufficient for one route should not be assumed to authorise another transaction with different conditions.
Civil Code Article 1013 likewise distinguishes registration based on the owner’s written declaration from acquisition supported by a statute, final court decision or equivalent document. A person acquiring a right before registration can request registration by presenting the necessary records. The exception must be connected to the actual legal basis; it is not a general right to bypass the registered owner whenever a private agreement is disputed.
Read the operative part of any judgment, not only its explanation. Confirm the property, beneficiary and registration consequence relied upon, together with the required procedural status. An appeal challenging a documentary refusal should identify where the submitted instrument satisfies the relevant rule. Where the underlying document does not establish the requested right, a different substantive proceeding may be necessary.
Consider the limited provisional-registration route
Article 1011 permits a provisional registration annotation to secure an asserted right in rem or where the law allows later completion of documents establishing disposition authority. It depends on the consent of all interested persons or a judicial decision. The article does not make every incomplete application provisionally registrable, and it does not remove the need for a legally identifiable right.
Article 1016 is more specific about one documentary situation: the legal-cause documents are complete, but the document establishing disposition authority needs completion. In that case an annotation can be made with the owner’s consent or a judge’s decision. A missing valid legal cause should not be presented as though it were merely a missing representative document within that qualification.
Where the judge orders an Article 1011 annotation, the decision defines its content and period of effect and can set a period for bringing proceedings. If the annotated right is subsequently established, it can be asserted against third parties from the annotation date. Those conditions explain the potential value of the mechanism, while also requiring prompt attention to the actual order and any deadline it contains.
A refusal must state its reasons and objection route
Article 26 requires non-compliant requests that cannot receive the specified provisional annotation to be refused without delay, with the reason, objection authority and period stated. The applicant should be able to identify why the transaction was rejected and where the decision can be challenged. A response that merely repeats the applicant’s commercial objective does not address the legal reasoning required by that article.
Prepare a reason-by-reason response. Quote only the necessary operative passage, identify the document or legal provision answering it and state the requested outcome. Where the applicant accepts a deficiency, explain the corrective document supplied. Where the refusal is disputed, distinguish disagreement about a factual record from disagreement about the legal requirement applied by the office.
The refusal’s existence is entered in the declarations column by reference to its date and journal number. Article 26 states that the refused transaction cannot be carried out before the refusal ground is removed. This makes the official reason important beyond the first appeal: an unchanged request should not be treated as though the earlier recorded obstacle simply disappeared.
The journal record is evidence, not a guarantee of success
Article 23 provides for recording requests requiring a registry transaction and refused requests in the journal. It also links priority of recorded rights to the journal date and sequence. Obtain the actual journal reference relevant to the application. A booking number, email timestamp or the date a representative first contacted the office is not necessarily the same legal record.
The regulation distinguishes the events preceding journal entry for transactions requiring an official deed, those using a request document and incoming official communications. The file should identify which process applied. Do not claim priority merely because the buyer began negotiations earlier than another claimant. Priority questions need the appropriate journal and substantive right records.
Preserve the application receipt, signed request or deed where relevant, submitted attachments and refusal decision together. This permits the reviewer to compare what the office actually received with what the applicant now says was supplied. A later corrected document should be marked as a later submission rather than inserted into the original package without explanation.
The regional objection period is fifteen days from notification
Under Article 26(3), the refusal is served personally or under the Notification Law. Paragraph 4 permits objection to the regional directorate supervising the refusing office within fifteen days from notification. The starting event is the legally relevant notification of the refusal. The date of an informal discussion or the day the applicant eventually reads a forwarded summary should not automatically replace it.
Obtain the service document and identify the recipient and capacity. An overseas applicant should establish whether service was made to the applicant or an authorised representative and obtain the full record promptly. Calendar the objection against the actual decision. Do not assume that residence abroad creates an extension or that asking the office another question preserves the period.
The objection should identify the refusing office, applicant, property, decision and relief requested, with a clear explanation of the alleged error and supporting records. Keep evidence of submission and the complete version lodged. The objective is a reviewable response to the recorded refusal, not a collection of informal messages sent through unrelated channels.
A separate fifteen-day period applies to the central objection
Article 26 also permits objection against the regional directorate’s decision to the General Directorate within fifteen days from notification of that regional decision. This is a second decision and a second notification event. It should have its own entry in the chronology, with the received decision, service evidence and submission record preserved separately from the first objection.
Read how the regional decision answers the original grounds. It may leave a specific documentary or legal issue unresolved from the applicant’s perspective. The central objection should address that decision and the continuing dispute accurately, rather than simply attach the first petition without examining the response. Identify any additional evidence and explain why it bears on the decisive issue.
The two administrative objection periods should not be presented as a universal timetable for every possible lawsuit arising from the transaction. Article 26 supplies this defined registry route. Any separate judicial deadline and the effect of administrative steps on it require assessment under the rules governing the actual claim. An applicant should not assume that repeating objections indefinitely restarts all legal periods.
Distinguish review of the refusal from a disputed civil right
A registry review cannot be described as automatically resolving every disagreement between seller and buyer, heirs, co-owners or competing right holders. The office applies the documents and law within its registration function. Where the claimant needs a judicial determination of an underlying right, the requested court relief must be framed accordingly. A refusal can expose that need without itself deciding the whole civil dispute.
The site’s missing title-record guide concerns obtaining and checking ownership information. That information is also essential here, but retrieving a copy is different from compelling a disputed transfer. Confirm whether the desired outcome is a record, a correction, an annotation, cancellation or registration of a newly established right.
Private contractual deadlines continue to deserve separate attention. Payment conditions, completion dates and obligations to supply documents can matter even while a registry objection is pending. Preserve the agreement and correspondence without assuming that an administrative refusal automatically cancels the contract or creates a fixed refund entitlement. The contractual remedy must be connected to the actual undertaking and applicable substantive law.
Close the file with the actual outcome and updated record
A successful objection should be followed through to the registry action it permits. Obtain the resulting office communication and confirm what documents or steps remain necessary. Reversal of a refusal does not justify reporting that title has transferred before the required transaction and entry are actually completed. The client’s records should distinguish the review result from the final registered right.
For an applicant abroad, the working file should contain the original request, complete submitted documents, reasoned refusal, both service records where applicable, objections and later decisions. Add the current title and a list of outstanding acts. This allows the representative to explain the precise stage reached and prevents repeated applications based on different versions of the facts.
The statutory framework rewards a focused response: establish entitlement and legal cause, identify the exact refusal ground, assess the limited provisional route, use the correct objection authority within the applicable period and verify the final entry. Each step should be supported by the actual official document. That is the basis for resolving the application without confusing an administrative review with a completed property acquisition.
Frequently asked questions
Is a missing-document request always an Article 26 refusal?
No. Determine whether a formal refusal was issued and served. Incomplete preparation and the formal refusal procedure are distinct stages.
What must a formal refusal state?
Article 26 requires the reason, objection authority and objection period, together with the refusal of the non-compliant request within its scope.
Where is the first objection made?
To the regional directorate supervising the refusing land-registry office, within fifteen days from notification of the refusal.
Can the regional decision also be challenged?
Article 26 permits an objection to the General Directorate within fifteen days from notification of the regional decision.
Does living abroad automatically extend those periods?
Article 26 does not provide such an automatic extension. Establish the legally effective notification and obtain the record promptly.
Can every incomplete file receive provisional registration?
No. Civil Code Articles 1011 and 1016 contain specific conditions, including the relevant consent or judicial decision. A missing legal cause is not automatically curable through that route.
Does a valid power of attorney resolve every refusal?
No. Authority and the legal cause are separate requirements under Article 1015. The underlying transaction and required form must also be established.
Can I repeat the same request without addressing the refusal?
Article 26 states that the refused transaction cannot be carried out before its refusal ground is removed. Identify the recorded obstacle and the appropriate correction or challenge.
Does winning the objection mean ownership has already changed?
Not necessarily. Confirm the further transaction steps and the actual registry entry rather than equating reversal of a refusal with completed registration.
What should I send for a review from abroad?
Send the complete refusal, service evidence, application and attachments, current title, representation documents and every regional or central decision already received.
