Notice Pay in Turkey: Termination Periods, Resignation and Final Pay
What is notice pay in Turkey?
Notice pay, commonly called ihbar tazminatı, addresses failure to observe the applicable termination notice requirement. Article 17 of Labour Law No. 4857 provides ordinary minimum notice periods of two, four, six or eight weeks according to service for indefinite-term employment. The employer can terminate by paying the corresponding amount in advance. Notice pay is not the same as severance, unpaid salary or compensation arising from a successful reinstatement claim.

The analysis begins with who ended the contract, the legal ground, the type of contract and whether a valid notice period was served. Both employer dismissal and employee resignation require attention. This guide explains those questions for English-speaking employees and employers; it is not a personalised final-pay calculation. Our English legal services homepage explains our Istanbul and Mersin offices and Turkey-wide coordination.
The Article 17 notice bands
| Statutory service band | Minimum notice |
|---|---|
| Less than six months | Two weeks |
| Six months to one and a half years | Four weeks |
| One and a half years to three years | Six weeks |
| More than three years | Eight weeks |
These reproduce the statutory bands in English. Exact service dates, anniversary boundaries and any more favourable contractual provision must be checked before calculating the applicable period. Notice weeks should not be confused with the number of shifts normally worked in a week.
1. Identify the legal event before asking how many weeks are payable
Obtain the contract, the termination notice and the employee’s response. Identify whether the employer dismissed the employee, the employee resigned, a fixed term expired, or the parties signed a mutual termination arrangement. These are different legal events even when the personnel department uses the same exit form for all of them.
A payment described as an exit package does not itself establish that it includes notice pay. Read the calculation and agreement to see which amount belongs to which head. An employer and employee should not use different meanings for the same transfer when later discussing whether a balance remains.
Article 17 addresses indefinite-term contracts within the relevant Labour Law framework. The expiry or early termination of a fixed-term arrangement raises separate questions. Do not force every employment dispute into the two-to-eight-week table merely because it is familiar.
The governing legislation also matters. An ordinary employee, a worker under a special employment statute and a genuine independent contractor do not necessarily have identical notice rights. Foreign nationality and the language of the contract are not substitutes for identifying the actual legal relationship.
2. Establish service and inspect any contractual notice provision
Write down the employment commencement date and all relevant changes. Check whether earlier work at another location belonged to the same continuing relationship. A new office address or a revised payroll system is not, by itself, proof that service began again from zero.
Where employment was interrupted, preserve the documents describing why and when. A proper assessment distinguishes a transfer, suspension, new employment agreement and actual break. Do not present a rounded number of years when a precise date determines the notice band.
Article 17 states that its periods are minimums and permits contractual increases. Read the contract and collective agreement before relying only on the statutory table. The wording and application of an enhanced provision require examination, including whose obligation is being assessed.
Be particularly careful around an anniversary. A statement that someone worked about eighteen months is not sufficiently precise for a final calculation. Record the dates and identify the clause being applied. A documented chronology is more reliable than an online calculator fed with approximate inputs.
3. Distinguish continuing notice from immediate termination with payment
Under working notice, the relationship continues during the relevant period, with the applicable employment obligations and rights. An employee’s final working day, release from attendance and legal termination date should therefore be stated clearly instead of left to inference.
Article 17 permits the employer to terminate by paying the notice-period amount in advance. A message saying not to come to work tomorrow should be assessed with the accompanying notice and payment arrangement. It should not automatically be treated as both a fully worked notice period and an unpaid immediate dismissal.
Keep any agreement releasing the employee from attendance. Being told not to enter the workplace is different from choosing not to attend contrary to instructions. A clear written record can prevent a later dispute about whether an employee abandoned work during notice.
Do not assume that a partly served period can always be resolved by subtracting a few days from the statutory figure without further analysis. Record the notice given, the period actually served and the later instruction that changed it. The legal consequence of an incomplete or altered notice arrangement needs its own assessment.
4. Resignation can create a notice issue for the employee
The notice requirement is not exclusively an employer obligation. Article 17 addresses the party failing to observe it. An employee planning to leave an indefinite-term position should therefore distinguish an ordinary resignation from termination relying on a legally justified immediate ground.
Give the employer an accurate written statement of the intended departure and retain evidence of delivery. Do not write that every entitlement was paid merely to make a resignation letter appear polite. The notice of departure and the financial reconciliation can be separate documents.
Where the employee needs an earlier departure, document any agreement rather than relying on an informal assurance from someone without clear authority. State the agreed date and what, if anything, is being accepted or reserved concerning notice. Avoid an ambiguous message that can later be read as merely acknowledging receipt of the resignation.
Starting a new job, relocating abroad or booking travel does not automatically remove the prior employment obligations. At the same time, a notice dispute does not authorise either party to invent an unrelated payment condition. Each side’s position should be assessed under the relevant rules and the actual departure agreement.
5. Immediate termination and probation require their own analysis
Articles 24 and 25 address specified immediate-termination grounds for employees and employers. The factual ground, applicable conditions and any relevant time limit must be established. Simply inserting the words just cause into a letter does not prove that the statutory requirements were met.
Keep records of the event relied upon and when it became known. A dispute over unpaid wages, alleged misconduct or another serious event can involve different provisions. Do not assume that every justified departure produces notice compensation in favour of the party who elected to terminate immediately; avoiding a notice obligation and receiving notice compensation are different questions.
Article 15 addresses an agreed probationary period, ordinarily limited to two months and extendable to four through a collective agreement. Within a valid probation period, the statute permits termination without notice or the corresponding compensation while preserving earned wages and other rights. A probation label used after the permitted period has ended needs examination.
The Labour Law text is the starting source for these exceptions. A final assessment must identify the actual termination route rather than adding the maximum notice amount to every departure.
6. Job-search leave is a separate right during the relevant notice period
Article 27 requires paid time during working hours to seek new employment, with a minimum of two hours per day. The provision also sets conditions for combining the time before departure and notifying the employer. Keep the request and the arrangement made.
A notice period is not fully explained by recording the employee’s attendance at work. Identify whether the required job-search time was provided, reduced or worked through. The statute specifies financial consequences where the employer fails to provide the time or requires work during it.
Do not relabel job-search time as ordinary annual leave. Article 59 separately addresses the non-overlap of annual leave with the employer’s termination notice period and required job-search leave. The annual leave guide explains why those accounts should remain distinct.
An agreed handover plan should therefore leave room for the relevant statutory rights. Preparing instructions for a replacement, returning equipment and assisting colleagues do not automatically eliminate the employee’s job-search entitlement.
7. Calculate the relevant wage basis, not only the last bank transfer
Article 17 requires consideration of the wage and the relevant monetary or money-measurable benefits arising from the contract and law. The correct basis is therefore not established merely by copying the amount of the last net salary transfer.
Identify regular benefits and their legal character. A meal benefit, transport benefit, recurring payment and reimbursement of a one-off business expense should not automatically be treated alike. Preserve the agreement and payroll history supporting inclusion or exclusion.
Separate the gross calculation from the net amount expected after applicable deductions. State the assumptions used and the date to which the calculation relates. Do not describe a gross figure as a guaranteed bank receipt.
Notice pay and severance have distinct legal bases. A ceiling or formula relevant to one should not be copied into the other without justification. Equally, an agreement providing an additional discretionary exit payment does not automatically change the statutory character of every other item.
Credit payments already received against the proper head. Where one transfer covers several amounts, request the breakdown and compare it with the payroll and agreement. An unallocated total is a reason to clarify the account, not to claim the entire sum again.
8. Keep notice pay separate from challenging the dismissal itself
Article 17 expressly preserves the application of the job-security provisions where their conditions are met. Paying notice does not by itself establish that dismissal was valid under those provisions. Conversely, disputing the dismissal’s validity does not mean every possible payment is already proved.
The reinstatement guide explains the separate one-month mediation deadline measured from notification of dismissal. Do not wait for the notice period to finish or the final account to be negotiated before checking that route.
Ordinary unpaid salary, overtime and unused leave each need their own periods, evidence and calculation. Presenting a single total called compensation can hide important differences in entitlement and deadlines.
A settlement should identify exactly which claims it resolves. An employee receiving a notice-related payment should understand whether the proposed document also concerns reinstatement, wages or a release of other disputed matters. Translation and independent review are particularly important where the document’s language is unfamiliar.
9. Prepare a compact, internally consistent evidence file
Keep the contract, service record, termination or resignation notice, delivery evidence, any agreement about early departure, final payroll and bank records. Add the job-search leave arrangement where relevant. A short index helps the reader identify each document’s purpose.
Explain inconsistencies rather than conceal them. A notice naming one final date and a payroll naming another may reflect a later agreement, an error or a different event. Preserve the subsequent communication that explains the change.
Do not sign a backdated acknowledgement to match a personnel system. Equally, do not deny a payment genuinely received. A reliable account distinguishes the disputed legal conclusion from facts that both parties can verify.
Where a representative acts, clarify the authority to negotiate or settle. A mandate to obtain documents does not necessarily mean the client has approved every compromise. Keep the client’s decision and the proposed financial terms clearly recorded.
10. A hypothetical four-year service calculation
Assume an ordinary indefinite-term employee has four years of relevant service, no increased contractual notice provision and a termination giving rise to the Article 17 payment. Assume the correctly assessed daily gross wage basis, including applicable benefits, is TRY 2,000. These are invented assumptions, not a legal assessment of a real employment file.
The statutory notice band in this example is eight weeks. Eight weeks correspond to fifty-six days, producing an illustrative gross starting calculation of TRY 112,000. Applicable deductions, previous payments and the actual legal basis must still be reconciled.
The figure would not be established merely because someone worked four years and then left. A valid immediate-termination ground, probation issue in another case, fixed-term classification or a different agreed notice arrangement would require a different analysis. The purpose of stating the assumptions is to make the calculation auditable.
The employee’s unpaid wages and unused leave are listed separately. Any reinstatement deadline is checked from the dismissal notification. A clear final account therefore contains several distinct entries rather than treating TRY 112,000 as the answer to every question arising from departure.
11. Assess mediation, limitation and collection separately
The Ministry of Justice guidance explains the pre-action labour mediation framework for claims within its scope. Prepare the correct parties, termination chronology, applicable notice period and calculation before the meeting.
Additional Article 3 of Labour Law No. 4857 provides the five-year period for the specified notice-related compensation, with transitional rules relevant to older cases. This should not be confused with the much shorter reinstatement procedure. A general statement that employment claims allow years to sue is unsafe where a different urgent remedy is being considered.
If payment remains disputed, examine the competent court and enforcement position. A documented entitlement, a judgment and actual collection are different stages. Do not assume that a notice-pay calculation guarantees immediate payment from an employer whose position has not been examined.
12. Coordinate the final account after leaving Turkey
Save the employment documents before company account access ends. Keep a reliable address and communication channel, and identify any outstanding permit or procedural date. A final-pay dispute does not itself extend immigration permission or authorise work for a new employer.

Frequently asked questions
Is notice pay the same as severance?
No. They have different legal bases, conditions and calculations.
Must I complete one year before any notice right exists?
Article 17 includes a notice band for service below six months. The contract and termination route still need examination.
Can an ordinary resignation create liability for the employee?
Yes, failure to observe an applicable notice requirement can raise a claim. Any valid immediate-termination ground or departure agreement must be assessed separately.
Does a probation clause last indefinitely?
No. Article 15 sets limits on an agreed probation period. A label alone cannot extend it without the relevant legal basis.
Are notice weeks just the days I normally work?
No. Do not convert a weekly notice period into only scheduled shifts when calculating its duration or payment basis.
Does notice pay make every dismissal valid?
No. The job-security provisions remain separately relevant where their conditions are met.
Can annual leave replace job-search leave?
The rights are distinct. The statutory non-overlap and job-search provisions should be applied to the actual arrangement.
Does messaging the office preserve a deadline?
No. An enquiry does not establish representation or stop time running. Identify urgent dates expressly.
