Overtime Pay in Turkey: Working Hours, Evidence and Claims for Foreign Employees

overtime pay in Turkey: Overtime pay in Turkey explained in English: the 45-hour rule, additional hours, breaks, time off, payroll records and recovery of unpaid overtime.

How is overtime pay calculated in Turkey?

Under the ordinary Labour Law No. 4857 framework, work exceeding forty-five hours per week attracts a fifty-percent increase over the normal hourly wage, subject to the applicable working-time rules. Where the contract sets a shorter working week, additional hours up to forty-five attract a different twenty-five-percent increase. Lawful averaging arrangements, actual breaks and sector-specific restrictions must be assessed before counting payable hours. A building-access record showing a long day is evidence, not a completed overtime calculation.

This guide concerns proving and calculating additional working time. It should be read separately from the guide to unpaid ordinary wages and the annual leave and holiday-pay guide. Our English homepage explains legal matters coordinated from our Mersin office.

Start with the correct category of hours

QuestionOrdinary statutory starting point
Work beyond forty-five weekly hoursNormal hourly wage increased by fifty percent.
Contractual hours below forty-fiveAdditional hours up to forty-five are assessed separately at the twenty-five-percent increase.
Actual rest breaksBreaks are not counted as working time under Article 68.
Time off instead of paymentThe employee’s statutory choice and the applicable enhanced time entitlement must be respected.
Special arrangementsCheck averaging, daily limits, night work and the governing employment category.

1. Identify the contractual working week and applicable law

Obtain the employment contract, any working-time amendment and the applicable workplace or collective rules. Identify whether the agreed week is forty, forty-five or another lawful arrangement. The contract’s language does not eliminate mandatory Turkish employment rules when they govern the relationship, but the applicable framework must first be established.

Do not assume that every worker belongs to the same regime. Maritime employment, excluded occupations, public employment and genuine independent services require separate analysis. A foreign consultant’s invoice for additional project work should not automatically be treated as an employee’s statutory overtime claim.

Read salary-inclusive wording carefully. A clause saying that some additional work is included in remuneration needs examination of its terms, the wage and the relevant legal limits. It is not an unrestricted instruction that every extra hour is permanently unpaid. Equally, a calculation should not ignore an applicable arrangement without considering the documents.

Keep changes in role and schedule on a timeline. Someone who moved from daytime administration to rotating shifts may have different evidence and calculations for the two periods. Treating several years as one identical weekly pattern can conceal both genuine entitlement and genuine variations.

The Labour Law, particularly Articles 41, 63, 66, 68 and 69, supplies the main statutory distinctions used in this guide. The employment file should show which of those distinctions actually matters rather than reciting every provision without applying it.

2. Build the working-time account one week at a time

For each disputed week, record the date, starting time, finishing time, actual breaks and the work performed. Add the source supporting the entry, such as a shift roster, task record or contemporaneous instruction. This makes the account verifiable and helps identify gaps before a demand is sent.

Separate scheduled hours from actual hours. A published roster can show what was expected, while a later instruction, replacement shift or early closure changes what occurred. Preserve both versions and explain the difference instead of selecting whichever produces a larger total.

Do not count the same time twice when an overnight shift crosses midnight. Keep the date and time sequence clear, especially where payroll groups a shift by its starting day. For remote work involving another country, state the time zone used in the underlying records.

Exclude periods not worked for the reason being claimed. Annual leave, sickness absence and a full week away are not ordinary evidence that the employee worked their usual overtime pattern during that week. Other paid entitlements may arise, but they should not be disguised as additional hours physically worked.

3. Distinguish genuine breaks from work, and ordinary commuting from assigned travel

Article 68 regulates minimum breaks and states that breaks are not counted as working time. The factual question remains whether the stated break was genuinely taken. A fixed software deduction of one hour does not itself explain what happened when an employee was instructed to keep serving customers or attending machinery throughout that period.

Preserve the actual instructions and working conditions. Describe whether the employee could stop work, whether another person provided cover and what tasks continued. Avoid claiming that every minute spent inside the workplace was necessarily work; a genuine meal break still needs to be distinguished from duty.

Article 66 identifies particular periods counted as working time, including certain employer-directed travel, readiness for work and assigned activities away from the normal task. It also distinguishes transport supplied merely as a social benefit from the circumstances specified by the provision. An ordinary commute and a journey ordered as part of the job should not be automatically treated alike.

Travel records need a purpose and chronology. Keep the assignment, departure and arrival details and any work undertaken during the journey. A flight ticket proves travel; the reason for it and the applicable rule determine its significance for the working-time account.

4. Test an averaging arrangement instead of using a monthly shortcut

Articles 41 and 63 recognise working-time averaging under specified conditions. Some weeks above forty-five hours are therefore not automatically overtime when a lawful arrangement keeps the relevant average within the normal limit. The arrangement, reference period and daily limits all need to be established.

Ask the employer to identify the period relied upon and supply the complete schedule, including the lighter weeks said to balance the heavier ones. A general statement that work “balances out eventually” does not identify a legally relevant calculation.

The ordinary statutory period and the sector-specific tourism provisions are not identical. A collective agreement can also affect the permitted period within the legislation. State which rule is being applied before combining weeks. Do not import a tourism arrangement into an unrelated office job simply because it is convenient.

Keep lawful averaging separate from compensatory work under Article 64 and from time off chosen in exchange for overtime. They are different mechanisms. Labelling every later quiet afternoon as repayment of earlier overtime prevents a clear assessment of whether any particular mechanism was validly used.

5. Calculate the wage basis separately from the number of hours

The first question is the number and category of qualifying hours. The second is the normal hourly wage used for the relevant period. A pay rise during the claim period creates a new rate period; it does not justify valuing all historical hours at the latest salary without examining the applicable basis.

Distinguish gross remuneration from net bank receipts. Payroll deductions, reimbursements and unrelated payments can make a bank transfer different from the wage basis required for the calculation. Preserve payslips, the pay agreement and changes rather than relying on a single recent deposit.

The statutory uplift is an increase over the normal hourly rate. For ordinary overtime, a normal hourly amount of TRY 200 produces TRY 300 per qualifying hour before considering applicable deductions. The additional-hours category up to forty-five uses a different increase. These illustrative rates are not a statutory minimum or a fee quotation.

Record overtime payments already received against the corresponding period. A payroll entry called “bonus” should be investigated before assuming it settles overtime, while a clearly evidenced overtime payment should not be omitted from the reconciliation. Explain the allocation of each credit.

6. Examine the employee’s choice of time off and the records of its use

Article 41 allows the employee to choose enhanced time off instead of the increased payment: one hour and thirty minutes for an overtime hour, or one hour and fifteen minutes for the relevant additional-hours category. The statute places use within six months, during working time and without a wage reduction.

A later day off is not automatically proof that this choice was made. Ask for the request or agreement, the hours being settled and the record of time actually taken. An employer should not casually substitute ordinary annual leave for the separate time-off entitlement.

Keep the two balances distinct. Annual leave records answer a different question, as explained in the annual leave guide. A personnel system should not reduce the annual-leave balance merely because the employee used a separately earned overtime time-off entitlement.

Consent to overtime concerns whether additional work is required under the applicable framework; it is not the same as an agreement that no remuneration is due. Review the consent document and any later change without treating a signature as a universal waiver of statutory rights.

7. Do not confuse a working-time limit with a payment calculation

Article 41 sets the ordinary annual overtime limit at 270 hours. That figure is a limit on the arrangement, not a monthly allowance to be added to every employee’s schedule. Keep the actual annual record and assess any alleged excess rather than deleting inconvenient hours from the evidence.

Daily working limits and night-work rules are separate safeguards. Article 63 addresses the eleven-hour daily limit in distributing weekly hours, while Article 69 contains the night-work framework and specified sectoral qualifications. Meeting a weekly average does not answer every daily-rest or night-work issue.

Underground mining and other protected working arrangements require their own rules. Do not use the ordinary forty-five-hour and fifty-percent example for every worker regardless of the statutory category. Identify the occupation and the actual duties before preparing a final claim.

A safety concern should be addressed as a safety concern, not postponed solely to build a compensation file. Record the facts and obtain advice about the appropriate immediate route. A payment dispute does not authorise unsafe conduct by either side.

8. Preserve evidence lawfully and explain what each record proves

Useful material includes shift schedules, time records, work orders, customer-service logs, payroll and messages requesting extra work. Each source proves different facts. A late email can establish that a message was sent, but not necessarily several continuous hours of work before it.

Witness evidence should relate to what the witness observed and the period when they worked with the employee. A colleague who left the business two years earlier should not be asked to confirm later shifts they never saw. Avoid scripted accounts that erase real variations in working arrangements.

Do not access a former employer’s systems without authority or copy unrelated customer databases. Preserve lawfully available relevant evidence and discuss how additional records can be obtained through the appropriate procedure. An otherwise valid wage dispute does not excuse an unlawful method of gathering documents.

Where personal attendance records are inaccurate, the personal-data request guide explains the separate information and correction process. That route does not itself determine the wage amount or replace the employment claim.

9. Two examples showing why the categories matter

Assume an ordinary employee with a forty-five-hour contractual week works fifty qualifying hours, after actual breaks are excluded, with no applicable averaging arrangement. Assume a normal gross hourly wage of TRY 200. The five ordinary overtime hours in this illustrative week produce TRY 1,500 at the fifty-percent increase.

Now assume a different ordinary employee with a forty-hour contractual week works forty-eight qualifying hours under the same illustrative hourly rate, again without averaging. Five hours fall between the contractual forty and the statutory forty-five, while three are above forty-five. The first category produces TRY 1,250 and the second TRY 900, making TRY 2,150 before relevant deductions and credits.

These invented examples isolate the arithmetic. They do not determine whether a particular salary-inclusive term applies, whether the records prove the claimed hours or whether another employment regime controls. They also exclude separate public-holiday and weekly-rest claims.

A real schedule should be equally transparent. Readers should be able to reproduce the hours, rates and credits without reverse-engineering an unexplained total. Where the employer disputes a particular week, that week can then be examined separately.

10. Prepare the demand, mediation file and limitation chronology

A payment demand should identify the employer, employment period, contractual schedule and amount claimed by period. Attach a concise working-time schedule and principal records. Separate unpaid overtime from ordinary salary, annual leave and any termination-related compensation.

The Ministry of Justice guidance explains the labour mediation requirement for claims within its scope. Prepare the particular disputed heads of claim rather than relying on an undefined demand for every conceivable employee right.

Wage-related limitation analysis requires attention to the relevant due dates and applicable rules. Do not assume that every overtime claim starts running only when employment ends. The unpaid wages guide explains the importance of a period-by-period account.

If mediation does not resolve the dispute, the competent court, evidence and calculation require assessment. A large spreadsheet is not a substitute for proof, and a favourable decision is not a guarantee of collection. Keep the procedural and enforcement objectives distinct.

11. Coordinate an overtime dispute from outside Turkey

Preserve records before a work email or attendance account becomes inaccessible. Keep original files and an organised readable copy. Explain any missing period honestly, and identify urgent dates before beginning an extensive translation exercise.

Frequently asked questions

Does every long day automatically count as overtime?

No. Actual hours, breaks, weekly calculations, lawful arrangements and any separate daily-limit issue must be distinguished.

Are hours above a forty-hour contract always paid at fifty percent extra?

Not under the ordinary statutory distinction. Additional hours up to forty-five use the twenty-five-percent increase; hours above forty-five fall into the ordinary overtime category, subject to the applicable rules.

Consent to work and the financial treatment of that work are separate questions. A signature is not a universal waiver.

Can time off be deducted from annual leave?

The statutory overtime time-off entitlement and annual leave are separate. Their records and legal bases should remain distinct.

Is a late email enough to prove a whole evening of work?

Not by itself. The message should be assessed alongside tasks, instructions and other evidence of the actual working period.

Should I use the same hourly wage for several years?

Identify the applicable wage for each period and any changes. Do not apply a convenient single rate without a legal and factual basis.

Can a lawyer inspect the documents while I am abroad?

Yes, an initial assessment can be organised remotely. Authority and any required procedural attendance are assessed for the file.

Does sending a spreadsheet preserve a deadline?

No. An enquiry or draft calculation does not itself establish representation or stop time running.
