Unfair Dismissal and Reinstatement in Turkey: A Guide for Foreign Employees

unfair dismissal in Turkey: An English guide to challenging dismissal in Turkey: job-security conditions, the one-month mediation deadline, evidence, reinstatement proceedings and the steps after judgment.

Can a dismissed foreign employee seek reinstatement in Turkey?

Foreign nationality does not itself exclude an employee from the Turkish job-security framework, but the statutory eligibility conditions must be met. Under Articles 18–21 of Labour Law No. 4857, a qualifying employee challenging dismissal must apply for mediation within one month of notification of the dismissal. If mediation ends without agreement, the ordinary court deadline is two weeks from the final mediation record. Do not wait until the final salary arrives or a notice period ends before checking these deadlines.

The Turkish term işe iade refers to the reinstatement procedure. It is different from simply requesting unpaid wages or a severance payment. This guide explains eligibility, evidence and the later return-to-work steps without promising a particular outcome. For representation and English communication, see our English legal services homepage.

Keep the procedural stages separate

StageStatutory starting point
EligibilityAssess the employment framework, indefinite-term contract, service, workforce threshold and relevant exclusions.
MediationApply within one month of notification of dismissal.
Lawsuit after unsuccessful mediationTwo weeks from the final mediation record.
Application to return after a final decisionTen working days from notification of the final decision under Article 21.
Employer’s reinstatement stepThe separate one-month period following the employee’s qualifying application must be assessed.

These periods concern different events. A calendar month is not automatically the same as thirty days, and working-day periods require their own calculation.

1. Check the job-security conditions rather than assuming every dismissal follows one route

Article 18 sets the ordinary starting conditions: an indefinite-term employment contract, at least six months of qualifying service and a workplace meeting the thirty-worker threshold. The statute contains a service qualification exception for underground work and exclusions for specified employer representatives. The particular employment framework must also apply.

The worker count is not necessarily the number of people in the employee’s immediate team. Article 18 addresses the same employer’s workplaces in the same branch of activity. Obtain the employer’s legal identity and the relevant workplace information instead of treating the size of one office as conclusive.

Qualifying service also needs a chronology. The law addresses aggregation of service at the same employer’s workplaces. A workplace transfer, payroll change or disputed employer identity requires examination of the documents. Do not assume that each administrative change creates a completely new employment history.

Managerial exclusions turn on the statutory responsibilities and authority, not merely an impressive English job title. Preserve the job description, reporting line and actual hiring or dismissal powers. A title such as “manager” should not replace assessment of what the employee could actually decide.

A person outside this reinstatement framework is not automatically without every employment remedy. Unpaid remuneration, notice-related claims, contractual rights or other applicable protections require their own analysis. Eligibility for one procedure and the existence of all possible rights are different questions.

2. Distinguish the employment term from the duration of a permit

Read the signed contract and all renewals. Identify whether a fixed term is asserted, the stated reason for it and how the arrangement operated. A heading describing a contract as temporary does not by itself answer every legal question about its classification.

A foreign employee’s permit has a separate regulatory function. Its stated validity period should not be treated, without analysis, as a complete answer about the employment contract’s legal character. Conversely, the reinstatement procedure does not extend a permit or authorise work where the necessary permission is absent.

Obtain the work-permit documents, employer information and any termination-related notifications. Explain whether the employee remains in Turkey, has left, or proposes to work for a different business. Those practical circumstances should be addressed alongside the employment case, not concealed until a return-to-work invitation arrives.

Do not sign a new document merely to make old records look consistent. A backdated fixed-term agreement or resignation can create a dispute about the very event being challenged. Preserve the original record and obtain advice about genuine inconsistencies.

3. Preserve the dismissal notice and how it reached the employee

Article 19 requires a written dismissal notification identifying the reason clearly within the applicable framework. Keep the complete notice, envelope or electronic delivery record, the date of receipt and any acknowledgement signed. The last day physically worked and the date dismissal was notified are not necessarily the same.

A signature can acknowledge receipt without expressing agreement, but the actual wording matters. Read the entire document and obtain an explanation or translation before signing. A form titled “handover” can also contain a resignation, settlement or admission unrelated to returning office equipment.

Where dismissal was communicated verbally or through a messaging application, preserve the chronology immediately. Record who communicated what, when access ended and what subsequent documents arrived. Do not assume that the absence of a formal-looking letter means no deadline can possibly be relevant.

Keep company property return separate from accepting the dismissal’s validity. A signed equipment inventory should accurately identify the items returned. It should not contain invented acknowledgements about the employee’s performance or payment position simply because the employer uses one combined form.

4. Examine the actual reason instead of arguing only that dismissal felt unfair

Article 18 identifies relevant categories including capability, conduct and operational requirements, while also identifying reasons that do not qualify as valid grounds. Article 19 addresses the employee’s defence where conduct or performance is relied upon, with the statutory qualification concerning Article 25(II). A performance allegation and a restructuring decision therefore require different evidence.

For performance, collect the role expectations, targets, assessments, feedback and any opportunity to respond. Identify when each standard was communicated. A negative rating is more informative when its measurement period and supporting material are visible.

For an operational explanation, preserve the notice and information identifying the change relied upon. A statement that a department closed raises different questions from an allegation of misconduct. Do not replace the employer’s stated reason with a different theory merely because a colleague speculates about what happened.

Where a prohibited or different reason is alleged, identify the facts supporting that allegation. Separate direct observations, documents and inferences. The employee’s account should make clear which conclusion is being drawn and from what evidence, rather than presenting suspicion as an established fact.

The Labour Law is the starting source for these distinctions. A final assessment requires applying the statutory framework and relevant judicial standards to the actual record, not guaranteeing reinstatement from one isolated defect.

5. Build a chronological file with a defined evidential purpose

The core documents are the contract, renewals, service history, job description, dismissal notice, delivery evidence and the material relating to the stated reason. Add the final payroll and any settlement proposal, but keep the dismissal challenge separate from the numerical calculation of unpaid amounts.

Use a short timeline showing recruitment, role changes, relevant evaluations, warnings or discussions, the dismissal notice and subsequent communications. Each entry should identify its source. This helps distinguish contemporaneous evidence from a later recollection.

Preserve lawfully available work records before access closes. Do not enter a former employer’s system without authority or copy unrelated customer information to strengthen a case. Ask how missing relevant records can be obtained through the proper procedure.

Witnesses should describe what they actually know. Someone who heard about the dismissal afterwards is not the same as a participant in the relevant meeting. An honest account of limited knowledge is more useful than a scripted statement purporting to confirm every disputed fact.

6. Protect the one-month application period

Article 20 measures the mediation application period from notification of dismissal. An internal grievance, a promise that management will reconsider or negotiations over an exit payment should not be assumed to postpone that period. Check the date before investing time in lengthy correspondence.

The application should identify the reinstatement dispute and the appropriate parties. Employment monetary claims can also require assessment, but an application framed only as a request for salary should not casually be treated as resolving every procedural question about reinstatement.

The Ministry of Justice’s mediation guidance explains the general framework. For a client abroad, the representative’s authority and the practical communication arrangements must be prepared in time. Our English mediation guide addresses those arrangements.

A mediated agreement to reinstate requires the matters specified by Article 21 to be defined, including the return date and the relevant monetary consequences. A statement that the employer will “consider taking the employee back” is not the same as a properly defined reinstatement agreement.

Read any proposed release against the actual dispute. Identify whether a proposal resolves reinstatement, wages, leave pay or several claims together. A headline settlement amount does not explain which rights are being compromised or when payment and performance are due.

7. Treat the final mediation record as a new deadline event

When mediation ends without agreement, Article 20 gives the ordinary two-week period from the final record for bringing the reinstatement lawsuit. Obtain the record and confirm its date promptly. Do not wait for the mediator’s file to be discussed informally by every participant before checking the next step.

The statute places the burden of proving a valid dismissal reason on the employer, while an employee asserting that dismissal occurred for another reason must substantiate that assertion. This does not make evidence preparation unnecessary for either party.

The competent court, territorial jurisdiction and correctly identified employer must be assessed. The employee’s current residence abroad or preference for a particular Turkish city does not by itself determine jurisdiction. Explain where the work was performed and the employer’s relevant legal details.

Article 20 provides for expedited determination and the relevant appeal route, but that does not establish a guaranteed number of weeks for an individual case. Court workload, evidence and procedural developments affect the actual timetable. A responsible case assessment should not sell a fixed completion date as a statutory certainty.

8. A favourable decision is not the last required step

Article 21 requires the employee to apply to the employer to start work within ten working days following notification of the final decision. Missing that step has consequences under the statute. A lawyer’s message saying the case succeeded should therefore trigger a review of finality, service and the required application, not simply a payment expectation.

The application must genuinely concern returning to work. Keep the wording, delivery evidence and the employer’s response. An application made only as a formality while the employee refuses to consider any lawful return can produce a further dispute that cannot be resolved by the judgment headline alone.

The employer’s separate one-month period and any actual invitation must then be assessed. Examine the proposed role, location, commencement date and terms. Preserve communications rather than deciding from an incomplete telephone summary that the employer either reinstated or refused reinstatement.

For a foreign employee abroad, travel and work-authorisation issues need prompt coordination. Do not ignore a return invitation while assuming that the litigation automatically solved immigration requirements. Equally, do not promise to attend on a date that cannot be met without explaining the obstacle and obtaining advice.

9. Distinguish non-reinstatement compensation from other amounts

A payment for an unserved notice period answers a separate question from the validity of dismissal. Our notice pay and termination-period guide explains that calculation and why receiving notice pay does not by itself resolve the reinstatement dispute.

Within the ordinary Article 21 framework, failure to reinstate after the qualifying application can produce compensation between four and eight months’ wages, as determined under the legal framework. The statute separately addresses wages and other rights for the period not worked, up to four months. Neither figure is a universal automatic maximum award in every dismissal dispute.

The law specifies monetary determination by reference to the wage at the lawsuit date for the relevant heads. Payroll components and statutory deductions should be assessed for each item. Do not combine gross figures, net figures and unrelated claims into a single unexplained promise of recovery.

Payments already made, including notice-related or severance payments, require reconciliation under the applicable outcome. Reinstatement and non-reinstatement have different consequences. An assessment should explain the scenario being calculated.

Ordinary unpaid wages, overtime pay and unused annual leave pay must retain their own factual and legal basis. A dismissal judgment does not automatically establish every number asserted under those headings.

10. A hypothetical employee working through notice

Consider an illustrative employee who receives a written dismissal notice but continues working for several further weeks under the notice arrangement. The employee assumes the reinstatement application period will begin only after the final working day. This is an invented example used to identify a procedural risk.

The first review obtains the notice and its delivery date. Eligibility and the stated dismissal reason are assessed immediately. The mediation deadline is checked from the notification event rather than postponed simply because the employment relationship continues during notice.

At the same time, the employee preserves performance records and the final-pay information. Salary and leave balances are calculated separately. If mediation does not resolve the reinstatement dispute, the final record generates the next deadline assessment.

The example illustrates why a valid employment complaint can be undermined by treating every date as the same date. Notification, last work, final payment, mediation completion and final judgment each have a different procedural role.

11. Arrange representation without losing control of the deadlines

Send a short chronology and the dismissal notice first, identifying the date of receipt expressly. A large untranslated file should not conceal an urgent deadline. Agree what is within the mandate and how decisions about settlement or return to work will be communicated.

Frequently asked questions

Is every dismissed worker eligible for reinstatement?

No. The statutory employment, contract, service, workforce and exclusion conditions must be examined.

Does my notice period postpone the mediation deadline?

Do not assume so. Article 20 starts from notification of dismissal, not automatically the final day worked.

Is one month always thirty days?

No. Calculate the statutory period under the applicable rules rather than converting every month into thirty days.

Does a manager title automatically exclude me?

The statutory authority and responsibilities matter. The English title alone does not establish the exclusion.

Can the employer’s internal appeal replace mediation?

It should not be treated as a substitute for the statutory application or as an automatic extension of its deadline.

Do I receive eight months’ compensation automatically?

No. The applicable outcome, conditions and judicial determination control the relevant compensation.

Is winning the lawsuit enough without a return application?

Article 21 requires the qualifying application within ten working days following notification of the final decision. The post-judgment steps must be addressed.

Does the case extend my work permit?

No. Employment proceedings and work-authorisation requirements are separate matters.
