Turkey Residence Permit 2026: Short-Term Permit, Property Rule and Articles 31–33

A Turkish short-term residence permit is a purpose-based immigration status governed principally by Articles 31, 32 and 33 of Law No. 6458 on Foreigners and International Protection. It is not a general right obtained simply by renting a home, opening a bank account or remaining in Türkiye for a certain number of days. The applicant must fit a statutory purpose under Article 31, satisfy the Article 32 conditions, and continue to use the permit for its stated purpose. For property-based applications, the current official e-Residence form states that the home must have had a value of at least USD 200,000 equivalent in Turkish lira on the acquisition date and must be used by the foreign owner as a residence.

IssueLegal starting pointWhat it means in practice
Available purposesLaw No. 6458, Article 31The foreigner must apply under a recognised statutory reason such as qualifying property ownership, business connections, tourism where accepted under current practice, treatment, education-related purposes and other listed grounds.

WorkLaw No. 6735 and Law No. 6458 Article 27A residence permit does not itself give a general right to work. A valid work permit ordinarily serves as a residence permit, subject to statutory exceptions.

1. Turkish law recognises six residence-permit categories

Article 30 of Law No. 6458 establishes six principal residence-permit categories: short-term, family, student, long-term, humanitarian and residence permits for victims of human trafficking. Search results often use the single phrase “Turkey residence permit,” but the legal rights and conditions differ substantially across those categories.

The short-term permit is the broadest category for many ordinary foreign residents and is regulated by Articles 31–33. A person applying because of property ownership is not using the same legal ground as a university student. A spouse relying on family residence is not using the same route as a foreigner establishing commercial connections. Classifying the application correctly is the first legal step because the evidence must correspond to the selected statutory purpose.

This is also why copying another foreigner’s document list can be misleading. Two applicants living at the same address may require different files because one is a property owner and the other relies on a family or student status.

2. Article 31 lists the purposes that can support a short-term residence permit

Article 31 contains the legal grounds for short-term residence. They include foreigners coming for scientific research; foreigners owning immovable property in Türkiye; persons establishing business or commercial connections; those participating in in-service training; participants in educational or similar programmes under agreements or student-exchange arrangements; persons staying for tourism; persons receiving medical treatment subject to the statutory public-health limitation; persons required to remain following a request or decision of judicial or administrative authorities; persons transferring from family residence in the circumstances specified by law; participants in Turkish-language courses; participants in education, research, internships or courses through public institutions; certain graduates applying within the statutory period; qualifying investors and their foreign family members within the exceptional-citizenship framework; and citizens of the Turkish Republic of Northern Cyprus.

Each paragraph is a legal basis, not a decorative label. An application based on ownership should prove ownership and residential use. A commercial-connection application may require evidence of the person or company with whom business will be conducted. A Turkish-language-course application requires evidence connected to an authorised course and is subject to its own limitations.

The competent migration authority can test whether the facts genuinely support the selected purpose. Submitting a lease under a property-ownership ground or an informal business idea under a commercial ground does not meet the law merely because an online application form was completed successfully.

3. Article 32 sets conditions that operate in addition to the chosen purpose

Article 32 requires an applicant for short-term residence to claim one or more Article 31 grounds and submit supporting information and documents. The applicant must not fall within the relevant Article 7 entry-related restrictions, must live in accommodation conforming to general health and safety standards, must present a criminal-record certificate from the country of citizenship or legal residence when requested, and must provide address information in Türkiye.

The statutory structure therefore has two layers: a valid purpose and general eligibility conditions. Proving one does not excuse the other. A property owner who cannot establish the relevant identity, address or other requested requirements does not receive an unconditional permit solely because a title deed exists.

Likewise, the administration may ask for information necessary to determine whether the declared reason is real. The appropriate response is to document the genuine purpose, not manufacture an artificial paper trail after the authority raises questions.

4. Property-based residence in 2026: the current official form states a USD 200,000 minimum home value

For foreigners applying under the Article 31 property-ownership ground, the official e-Residence application-document form currently states that the immovable property must be a residence belonging to the applicant and that its value must have been at least USD 200,000 equivalent in Turkish lira as of the date of acquisition. The home must actually be used by the foreigner as a residence; the official form states that it cannot be used for rent or similar income-producing purposes for this application ground.

This USD 200,000 rule must not be confused with the USD 400,000 real-estate threshold for exceptional citizenship. They serve different legal regimes. A person seeking a property-based short-term residence permit is applying under Law No. 6458. A person seeking citizenship by qualifying real-estate investment uses the exceptional-citizenship framework under Law No. 5901 and its regulation.

Our separate Turkish citizenship by investment guide explains the USD 400,000 citizenship route. Combining the two thresholds in one claim is a common and serious error.

Family members can raise another issue. Official Migration Management information states that where family members have shared or joint ownership rights in the residential property, family members can also apply within this property ground; for this purpose family members are described as the applicant’s spouse, minor child and dependent adult child. Ownership and family relationship must be documented.

Do not buy property solely on a seller’s promise that “any apartment gives ikamet.” The legal ground depends on current immigration rules, property value, residential status, ownership and actual residential use.

5. A rental contract alone does not create an unconditional right to a residence permit

Renting accommodation can prove where an applicant lives, but accommodation evidence and the legal reason for residence are different things. Article 31 requires an eligible purpose. A lease does not itself add a new statutory category to the law.

This distinction is important for tourism-based applications. A foreigner may have a valid notarised lease and still need to establish that the selected short-term-residence purpose is accepted and supported under the current administrative assessment. The lease answers the accommodation question; it does not guarantee the substantive immigration decision.

Applicants should also check whether the address can lawfully be registered for the intended purpose and whether any current neighbourhood/address restrictions or administrative policies affect the file. Those operational rules can change and should be checked on the filing date rather than copied from an old social-media post.

6. Tourism is listed in Article 31, but the purpose must be credible and documented

Article 31 includes foreigners who will stay for tourism. This statutory ground should not be presented as an automatic one-year permit for every visitor. The authority can examine travel plans, intended length and place of stay, financial means and other facts needed to assess whether the declared tourism purpose is genuine.

A visa-free stay, e-visa or tourist visa and a residence permit are legally different. Lawful entry permits the person to remain for the period authorised by the entry regime; it does not automatically extend into a residence permit after an online application.

Where a tourism-based application is refused, the applicant should obtain and review the written decision rather than repeatedly submit identical applications without understanding the legal reason. A change of purpose should reflect a real change in circumstances, not merely a different box selected in the online system.

7. Business or commercial connection requires more than forming a company on paper

Article 31 allows short-term residence for foreigners establishing business or commercial connections. Migration Management states that for requests exceeding three months the foreigner may be asked for an invitation letter or similar documents from the persons or companies to be contacted.

Company shareholding and residence status should remain conceptually separate. Registering a company does not automatically create an unlimited immigration right, and a residence permit does not by itself authorise the foreigner to perform work that requires a work permit. The factual commercial purpose should be supported by genuine company or transaction documentation.

Foreign directors, employees and shareholders should separately analyse the International Labour Law No. 6735 when they will work in Türkiye. An immigration strategy that ignores labour authorisation can create penalties even where residence status is valid.

8. Health insurance and medical-treatment grounds must be matched to the actual status

Health coverage requirements depend on the applicant’s category, age, social-security position and the applicable residence rules. The correct policy should cover the requested period and satisfy current immigration specifications where private insurance is required. A travel policy sold for a short holiday should not be assumed to satisfy a residence-permit requirement.

Article 31 also provides a specific short-term residence ground for medical treatment, subject to the rule concerning diseases regarded as a threat to public health. Migration Management can require evidence from the health institution concerning the treatment. The existence of a medical appointment does not convert an unrelated long-term stay into this category without genuine treatment documentation.

Where treatment costs are certified as paid by public institutions, the applicable administrative rules can affect the insurance-document requirement. The file should therefore use current official instructions rather than a generic checklist.

9. Passport validity is a separate documentary requirement

Migration Management’s current guidance states that, during evaluation, the passport or passport-substitute document must extend at least sixty days beyond the requested residence-permit period. Applicants with an expiring passport should therefore resolve renewal early enough for the residence file to be assessed with a compliant document.

Identity details across the passport, foreign birth records, marriage records and Turkish immigration records should match. Differences in transliteration, previous surnames or dates of birth can require explanation. Uploading inconsistent documents and hoping the authority will infer the connection is avoidable.

When a new passport is issued after an application or permit, the foreigner should follow the applicable notification/update procedure. A passport change does not erase the existing immigration record; the two identities must be linked correctly.

10. Address evidence must reflect where the applicant actually lives

Article 32 requires information on the address in Türkiye. Address is not merely correspondence detail; it can affect provincial competence, registration and the authority’s ability to verify accommodation. Property owners should ensure the address corresponds to the title record and actual residence. Tenants should use a genuine tenancy arrangement.

False or nominal addresses create legal risk. A foreigner should not register at an acquaintance’s address merely to bypass an administrative restriction while actually living elsewhere. Immigration records should reflect reality, and changes of address should be notified under the applicable rules.

For families, each person’s status and address record should be checked. A spouse or child does not necessarily acquire the principal applicant’s legal basis merely because everyone lives in the same dwelling.

11. Renewal is not an automatic extension of the old card

A residence-permit extension application requires the legal conditions to continue. Article 33 expressly provides for non-renewal where one or more short-term-permit conditions are no longer met or where the permit is being used outside its purpose.

A property owner who sold the qualifying home, a student who left the relevant educational status, or a person whose declared purpose no longer exists should not assume that the previous approval obliges the administration to renew the permit. The legal basis must be valid at the new assessment.

Applicants should file within the official extension period and preserve submission evidence. If a passport, insurance policy, address or civil-status document changed during the previous permit, the renewal file should be updated rather than blindly recycling the old packet.

12. Article 33 identifies refusal, cancellation and non-renewal grounds

Under Article 33 and Migration Management’s official explanation, a short-term residence permit is not granted, is cancelled if issued, or is not renewed when one or more statutory conditions are not or are no longer met; when the permit is used outside the purpose for which it was issued; when there is a current removal decision or entry ban; or when the applicable rule concerning time spent outside Türkiye is violated.

The legal response depends on the actual decision. A refusal based on insufficient evidence of purpose is different from a decision based on an entry ban. A cancellation based on misuse of the permit is different from a simple missing-document notice.

The date and method of notification matter for any administrative remedy or lawsuit. Applicants should retain the full refusal/cancellation document and envelope/e-notification information where applicable. A deadline should never be calculated from an informal phone call or social-media message.

13. A residence permit does not generally give the right to work

The Ministry of Labour expressly states that possession of a residence permit does not by itself authorise a foreigner to work in Türkiye. Work generally requires a work permit or a statutory exemption under Law No. 6735. Conversely, a valid work permit or qualifying work-permit exemption generally serves as a residence permit under Article 27 of Law No. 6458, subject to the special categories identified in the legislation.

This distinction is especially important for remote workers, company shareholders and foreigners who believe that a property-based residence card allows employment in a Turkish business. Immigration permission to reside and labour permission to work answer different legal questions.

Foreigners working without the required authorisation and employers engaging them can face administrative sanctions. A person planning to work should therefore design the work-permit route before commencing employment, not after an inspection.

14. Family members need a legal basis of their own

Family residence permits are governed separately from short-term permits. A spouse or child may qualify under the family-residence regime when the statutory sponsor and family conditions are satisfied. In other cases a family member may have an independent short-term, student or other permit ground.

Our Family Residence Permit After Divorce in Turkey guide explains how status must be reconsidered when the marriage underlying family residence ends. That issue should not be folded into a general short-term permit application.

For property-based short-term residence, the official rule concerning shared/joint ownership by qualifying family members can be relevant. The title deed and family relationship documents should be examined together rather than assuming that one owner’s card automatically extends to everyone in the household.

15. Foreign documents should be prepared for Turkish administrative use

Birth certificates, marriage certificates, criminal records, custody documents and other foreign public documents can require apostille or other legalisation and Turkish translation depending on the issuing state and purpose. The correct route depends on treaties and the document type.

Our apostille and certified translation guide explains these document-control principles. Applicants should avoid paying for unnecessary authentication of every document while failing to legalise the one record the authority actually needs.

If a lawyer is authorised from abroad, the power of attorney must cover the tasks that can lawfully be delegated. Personal appearance, fingerprints or authority-specific verification requirements remain personal where the procedure requires them.

16. Residence-permit matters coordinated from Mersin

The firm welcomes clients for in-person appointments at its Mersin location. Immigration and related administrative-law matters involving authorities elsewhere in Türkiye can be coordinated from Mersin subject to the competent provincial authority, court jurisdiction and procedural rules. This does not mean that every residence application or lawsuit is filed in Mersin.

For overseas clients, legal assistance can include selecting the correct statutory basis, reviewing property and civil-status documents, identifying inconsistencies, preparing legally usable foreign documents and assessing a refusal or cancellation decision. The scope of representation is determined by the specific mandate and the procedure.

A reliable Turkey residence permit application begins with Law No. 6458, not with a promise that a lease, bank balance or property automatically guarantees a card. Short-term residence requires a valid Article 31 purpose and compliance with Article 32. Article 33 then governs refusal, cancellation and non-renewal. For property-based applications, the current official e-Residence material requires a residential property valued at least USD 200,000 equivalent in Turkish lira at acquisition and used by the applicant as a home. Applicants should build evidence around the real legal purpose and current official rules.

Frequently asked questions

Is a Turkey residence permit guaranteed if I rent an apartment?

No. A lease proves accommodation; it does not itself create a statutory residence-permit ground. The applicant must fit a legal purpose under Law No. 6458.

What is the property value required for property-based short-term residence in 2026?

The current official e-Residence document form states that the home must have been worth at least USD 200,000 equivalent in Turkish lira on the date it was acquired.

Is the USD 200,000 residence rule the same as citizenship by investment?

No. Property-based residence and the USD 400,000 exceptional-citizenship route are separate legal regimes.

Can I rent out the home used for my property-based residence application?

The current official e-Residence form states that the property must be used by the foreign owner as a residence and cannot be used for rental or similar income-generating purposes for this ground.

Does a residence permit let me work in Türkiye?

Not generally. The Ministry of Labour states that residence permission alone does not confer the right to work. A work permit or statutory exemption is normally required.

How long can a short-term permit be issued?

Migration Management states that short-term permits are generally issued for up to two years at a time, subject to statutory exceptions for particular Article 31 grounds.

Can a short-term permit be cancelled before expiry?

Yes. Article 33 permits cancellation where the statutory conditions cease to exist or the permit is used outside its stated purpose, among other listed grounds.

Can family members use the property-ownership ground?

Official guidance allows qualifying family members with shared or joint ownership rights in the residence to apply under that ground, subject to proof of ownership and family relationship.

Does owning a company give me automatic residence permission?

No. Commercial connection is a recognised short-term residence purpose, but the facts and supporting documentation must satisfy the immigration assessment. Work authorisation remains a separate issue.

What should I do after a refusal?

Obtain the written decision and notification record, identify the precise statutory or factual reason, and calculate any remedy from the legally relevant notification date.
