Selling Property in Turkey: Residence-Permit Cancellation and the Next Application
Short answer
Selling the Turkish home relied on for a property-based short-term residence permit can remove the factual ground for that permit. Law No. 6458 Articles 31–33 require the relevant conditions to exist, while Article 29 allows an application for a permit matching a new lawful purpose. Implementation Regulation Article 26 requires a person who will remain after the original ground ends to apply within ten days of that ending. The expiry date printed on the card is not a guarantee that the property-based ground continues after sale. A cancellation decision, a transfer application and any separate removal decision require their own legal analysis.

Start with the legal basis of the permit, not ownership alone
A foreign property owner does not necessarily hold residence permission because of that property. The existing authorisation can rest on family, education, employment, long-term residence or another statutory ground. Before deciding what a sale changes, obtain the application, approval record and current permit details. The answer depends on the actual legal basis, rather than the owner’s assumption that every permit held by a homeowner is a property permit.
Law No. 6458 Article 31(1)(b) recognises foreigners with immovable property in Turkey within the short-term residence framework. Article 32 requires the relevant purpose and supporting documents, together with the other listed conditions. Under Article 33(1)(a), failure to satisfy those conditions, or their disappearance, is a ground for refusal, cancellation or non-renewal.
This article addresses the sale of the property relied on for that short-term ground. Citizenship obtained through an investment, an annotation restricting sale, a tax benefit and a long-term residence permit involve different rules. A conveyancing review should identify those separate arrangements without treating them as interchangeable consequences of the same title deed.
The sale changes ownership even when accommodation continues
The ownership record and the right to occupy the home answer different questions. After a transfer, continuing to live in the same apartment under a lease or the buyer’s permission does not preserve the seller’s former ownership. Accommodation evidence can remain relevant to another application, but it does not turn a tenant into the registered owner required for a property-based claim.
The Implementation Regulation, Article 28(3), connects the property ground with a residential property used for that purpose. Current Law No. 6458 Article 31(6), added in 2024, also assigns determination of the qualifying property’s nature and value to the Ministry. The analysis must therefore address both ownership and the applicable property criteria.
A sale agreement, the land-registry transfer and the date of moving out should be recorded separately. They can occur on different dates and prove different facts. An agent’s assurance that “the card is still valid” does not establish that the underlying immigration conditions continue. The relevant authority needs accurate evidence of the transaction and the foreign national’s current basis for staying.
Build a chronology before calculating any deadline
The file should distinguish the date the original permit ground ended, the date of a new application, the date of an administrative decision and the date of legal notification. These are not substitutes for one another. A transfer application triggered by the end of the original purpose operates on a different timetable from a lawsuit challenging a later cancellation decision.
For the property transaction, obtain the current and historical title records showing the applicant, property identifiers and registered transfer. Add the actual residence record, any replacement acquisition and the application documents that originally identified the property. This material establishes whether the administration connected the correct property and transaction to the correct person.
Do not calculate the entire case from the plastic card’s expiry date. The card records an authorised period, while the statute also regulates cancellation when conditions disappear. Likewise, an online status change and formal service of a written decision should both be preserved; their legal effects need to be assessed from the actual administrative record.
The ten-day rule addresses the end of the original ground
Article 29 allows a foreigner to request residence permission suitable for a new purpose when the original ground ends or a different ground arises. It creates an application route, not automatic approval of a substitute permit. The applicant must establish the new ground and the conditions applicable to it.
Implementation Regulation Article 26(1) requires foreigners who will continue staying in Turkey after the basis of their permit ends to apply to the relevant governorate for an appropriate permit within ten days from that ending. Article 26(2) provides that, for a transfer application within that framework, the existing permit is ended from the date its underlying ground ceased. The ten-day wording should not be recast as ten working days.
That rule makes advance coordination essential. A property sale should not leave the owner discovering the new-purpose documents only after completion. Where another ground already exists in addition to the original one, Article 26(3) separately addresses seeking a new permit without waiting for the ordinary extension window. Our guide to changing residence-permit types explains the broader transfer framework.
A replacement home or new purpose requires its own evidence
Purchasing another property does not justify treating two title records as one uninterrupted application file. Establish when the replacement was acquired, whether it meets the relevant residence criteria, whether it is used as the declared home and what information was supplied to Migration Management. A reservation, preliminary contract or payment to a developer is not equivalent to a current title entry establishing ownership.
Because Article 31(6) assigns property characteristics and value to the Ministry, the criteria applicable to the replacement acquisition and application must be checked against the current official materials. This article does not assume that the value or conditions accepted for the earlier property automatically govern a later purchase. The acquisition dates and documentary requirements should be identified expressly.
A non-property purpose also needs independent proof. Family residence requires its statutory family and sponsor conditions; education requires the appropriate educational basis; work authorisation follows its own regime. Describing an application as a “transfer” does not dispense with those requirements. Nor does moving into rented accommodation alone establish eligibility for any particular residence category.
Address updates do not replace a change of residence ground
A sale can involve both a change of ownership and a change of address. Recording the new address answers where the person lives. A transfer application answers why the person is legally entitled to stay. Completing one task does not necessarily complete the other, and the documents submitted for each should describe the same actual circumstances.
Implementation Regulation Article 23 addresses notifications of changes including residence address, and a move to another province has its own administrative consequences. The current address record should match the actual accommodation. Our residence address-registration guide explains the separate address duties and the twenty-working-day framework.
Preserve the lease or other accepted accommodation record, the date of the actual move and confirmation of the official address update. Continuing to use the sold property’s address after moving creates an additional evidential problem and can interfere with notifications. A buyer’s agreement to receive correspondence does not make an inaccurate residence declaration correct.
Review every family member’s status separately
Family members do not necessarily derive their permits from the same legal basis. The official property rule distinguishes family members who hold shared or joint ownership from those who do not. Article 28(3) of the Implementation Regulation states that non-owning family members cannot rely on the property in the same ownership capacity; it can instead be relevant to demonstrating financial means.
Obtain each person’s permit and supporting application. Determine whose ownership has ended, whether a separate family-residence relationship exists and whether a change affects a sponsor’s qualifying position. The sale should be assessed against each person’s actual record, rather than assuming that one household has a single collective permit.
Children’s interests and family ties are expressly relevant to residence decisions under Article 25. Evidence of schooling, care arrangements and actual dependency should be supplied where relevant. Those factors require consideration within the statutory assessment; they do not convert a sold property into continuing ownership or guarantee a particular permit outcome.
A cancellation notice must be read as a specific administrative act
Law No. 6458 Article 25 provides for governorates to issue and notify domestic refusal, non-renewal and cancellation decisions. Notification is made to the foreign national, legal representative or lawyer, with information on effective exercise of challenge rights and other rights and obligations during the process. Keep every page, attachment and service record.
Identify exactly what the decision says disappeared. The authority can refer to ownership, the residence purpose, accommodation, documentary compliance or another Article 32 condition. A challenge directed only at the sale price will not answer a decision actually based on absence of residential use. The petition should identify each stated reason and the evidence supporting or contradicting it.
Article 25 also requires consideration of matters including family ties in Turkey, residence duration, the position in the country of origin and the child’s best interests; it permits postponement of the residence decision. A reasoned submission should connect these statutory factors with documented circumstances. General statements about attachment to Turkey carry less evidential value than the underlying records.
Separate a factual mistake from a genuine change of eligibility
A claim that the administration used the wrong title record is different from an argument that a genuine sale should have been handled through another residence ground. The first requires accurate registry evidence identifying the error. The second requires the transfer chronology, the new purpose, the documents submitted and the legal rules governing that assessment.
Organise the file around the original permit, the property transaction, the continuing or new residence ground, the authority’s communications and service of the decision. Reconcile passport names, foreign identity numbers and title identifiers so that a transliteration or identity mismatch does not obscure the evidence. Retain the original records alongside any translations used for instructions.
Later acquisition of another home should be dated accurately. It is evidence of a later fact and should not be presented as ownership existing before it occurred. The legal effect of that acquisition on a fresh or transfer application, and on review of an earlier decision, must be argued separately. A clear timeline avoids asking a court to accept a factual continuity the documents do not establish.
The ordinary challenge period and suspension request are distinct
Under Administrative Procedure Law No. 2577 Article 7, the ordinary administrative-court filing period is sixty days where a special rule does not set another period. Written notification is central to the calculation; Articles 7–8 govern commencement and time computation. A lawyer should calculate the actual deadline from the service record and applicable procedure, including any properly made administrative application.
Article 11 permits a qualifying request to the superior authority, or the issuing authority where no superior exists, within the lawsuit period. Such a request stops the running filing period; after rejection or deemed rejection, elapsed time is still counted. An informal enquiry, a fresh residence application and a legally effective Article 11 request should not be assumed to have identical effects.
Article 27 provides that filing the action does not itself suspend the challenged act. Suspension requires the statutory conditions, including manifest unlawfulness and harm difficult or impossible to repair. The request should identify those grounds with evidence. The litigation deadline therefore must not be mistaken for permission to stay throughout that period or an automatic extension of the cancelled permit.
An owner abroad still needs a reliable notification and representation plan
A property sale completed by an authorised representative can take place while the owner is outside Turkey. That does not remove the need to check the residence record or deal with a notified cancellation. Keep the lawyer handling the residence issue informed of the completed title transfer, the owner’s location and any planned return journey.
Travel planning requires separate verification of the actual entry and residence position. A card physically held abroad can have an administrative status that differs from its printed expiry date. A pending residence lawsuit should not be treated as a visa, a new permit or an unrestricted right of entry. Review any additional administrative decision on its own terms.
Article 31(7), added in 2024, contains specific procedural rules for court challenges to short-term permit refusal or cancellation, including completion of the file after the defence stage and a special two-month period in the stated failed-service situation under Article 26(3) of Law No. 2577. This reinforces the need for an address where court notices can be handled and for prompt communication with the authorised lawyer.
Coordinate the sale file with the residence file before completion
The conveyancing instructions should identify whether the sold property supports the seller’s residence position. Agree who will obtain the final title record, communicate the completion date and supply the documents needed for any new application. This is a coordination task between two legal procedures; the land-registry transaction itself does not grant the next residence permission.
Keep administrative decisions separate from the commercial sale agreement. A promise by the buyer, estate agent or developer about future immigration approval cannot substitute for the competent authority’s assessment. The documentary plan should show an actual qualifying ground and a timely application, with alternative travel arrangements considered where lawful continuation is unavailable.
After completion, verify the application receipt, official address and any pending notification. Where cancellation has already occurred, preserve the challenge deadline while assessing the new purpose. The complete file should explain ownership before and after sale, the basis of the intended stay, the steps taken with Migration Management and the precise relief requested from any reviewing court.
Frequently asked questions
Does selling my home automatically cancel every type of Turkish residence permit?
No. The legal effect depends on the ground of the actual permit. This article concerns a short-term permit relying on the sold property. Family, student, work-related and long-term status require their own statutory analysis.
Can I rely on the expiry date printed on my residence card after sale?
The printed period does not guarantee that the underlying conditions continue. Article 33 addresses cancellation when the relevant conditions disappear. Check the actual record and prepare any necessary new-purpose application promptly.
How long do I have to apply when the original residence ground ends?
Implementation Regulation Article 26(1) specifies ten days from the end of the original ground for a person who will continue staying and seeks an appropriate permit. This is separate from the deadline for challenging a cancellation decision.
Does renting the same home back preserve property-based residence?
A lease establishes a different legal relationship from ownership. Continuing accommodation does not restore the former owner’s title. Any new residence application must rely on a ground whose conditions are actually satisfied.
Will buying another apartment automatically cure the problem?
No automatic continuity should be assumed. The acquisition date, ownership record, residential use, applicable property criteria and immigration application must be examined. A later purchase should be presented as a later fact.
Must I change my address as well as my residence application?
A move requires the applicable address procedure. Address registration and the legal purpose of residence are separate matters, so an address update alone does not replace a required change of permit basis.
What happens to my spouse’s or child’s permit?
Each person’s actual permit and supporting ground must be reviewed. Shared ownership, family sponsorship and independent residence grounds have different effects. Article 25 requires consideration of relevant family ties and the child’s best interests.
What is the ordinary lawsuit period for cancellation?
Law No. 2577 Article 7 supplies the general sixty-day administrative period where no special rule applies. The actual calculation depends on notification and any legally effective procedural step. A separate removal decision must be assessed independently.
Does filing a lawsuit allow me to stay until judgment?
Filing alone does not suspend the challenged act under Article 27. A suspension request has separate legal conditions, and the current lawful-stay position must be checked. The lawsuit is not itself a new residence permit.
Can the matter be managed while I am abroad?
An authorised lawyer can assess the title transfer, administrative file and notified decisions while coordinating with you abroad. Reliable service arrangements and current contact information are essential. Entry eligibility for a return journey remains a separate question.
